<br /> <br />ervi{{e <br /> <br />STAFF REPORT <br /> <br />DATE: <br /> <br />February 5, 2002 <br /> <br />TO: <br /> <br />Planning Commission <br />Kim Moore-Sykes, City Administrator 0N-'1 <br /> <br />FROM: <br /> <br />RE: Infonnation on Conditional Use Permits <br /> <br />............................................................................ <br /> <br />BACKGROUND <br />In November, the Planning Commission was hearing from residences regarding sheds <br />that had been constructed too close the their primary structure. In one situation, a <br />resident reported that the shed had collapsed and he rebuilt it in the same spot, not <br />realizing that it had been grandfuthered in and needed to be moved away from the house. <br />In the other situation, the homeowner added on to the primary structure, bringing it closer <br />to the accessory building. <br /> <br />During discussion with the Commission about these two situations, Staff asked if a <br />conditional use permit could be granted, listing the conditions that would allow for the <br />continued existence of the shed, but if it is destroyed 50% or more, the use is <br />discontinued and not allowed to be rebuilt. The Commission asked Staff to provide <br />additional infonnation. . <br /> <br />Attached is a copy of the zoning chapter from the City of St. Anthony's City Code, <br />whereby the City outlines permitted conditional uses in each of the zoning districts. <br />During the consideration of a conditional use permit, the Planning and Zoning <br />Commission would review the application, the proposed use and the regulations <br />regarding conditional uses. If the application was approved, conditions would be listed in <br />the findings of fuets and the petitioner was required to abide by the conditions or loose <br />the use 0 f the structure. <br /> <br />RECOMMENDATION <br />Consider implementing Conditional Use Permits for certain requests, based on a case-by- <br />case situation. <br />
