A lot in the R-2 District may be divided <br />into two separate lots with the party wall between the two dwelling units acting as the <br />dividing lot line, subject to the procedures and other requirements of Chapter 15, and <br />subject to the following conditions: <br /> <br />(a) The areas of the two lots must be as nearly equal as is reasonably possible, <br />and Each lot must contain no less than 1/2 the minimum land area <br />requirement for a two-family dwelling. <br /> <br />(b) Except for having no setback along the common property line, all other <br />setback and yard requirements must be met. <br /> <br />(c) No fence or shrubbery divider may be installed or maintained within the <br />required front yard of either lot. <br /> <br />(d) Separate services must be provided to each residential unit for sanltary <br />sewer, water, electricity, natural gas, telephone and other utilities. <br /> <br />(e) The common party wall must have the fire rating and sound transm.ission <br />control rating required under the Uniform Building Code. <br /> <br />(f) The owner must execute and record at the owner's expense a declaration of <br />covenants, conditions and restrictions in a fonn approved by the City <br />covering party walls, arbitration of disputes, maintenance of the structure, <br />exterior finishes, land smrounding the buildL'1g, architectural control, roofs <br />of different types and colors, and the right (but not the obligation) of the City <br />to enforce the provisions of the declaration. <br /> <br />Section 1625 - R-3 TOWNHOUSE DISTRICT <br /> <br />1625.01 Purpose. The purpose of the R-3 District is to provide areas (a) where the natural <br />amenities such as trees, hills and bodies of water are preserved by encouraging <br />development of medium density housing surrounded by common open space, (b) which <br />may serve as a transitional use between less dense residential districts and other districts, <br />and (c) which provide for alternatives to one and two family detached dwellings. <br /> <br />1625.02 Permitted Uses. Within an R-3 District only the following uses /lIe permitted: <br /> <br />(a) Uses permitted in the R-l, R-IA and R-2 Districts. <br /> <br />(b) Townhouse buildings containing not less than three units nor more than <br />eight units. <br /> <br />1625.03 Permitted Conditional U.es. Within an R-3 District, the following uses are <br />permitted only if a conditional use permit has been issued by the City Council: <br /> <br />(a) Uses permitted as conditional uses in the R-l, R-IA and R-2 Districts. <br /> <br />16-18 <br />
