<br />SECTION V <br />POWERS DUTIES AND OBLIGATIONS OF THE <br />GOVERNING BOARD <br /> <br />5.1 Powers. The Governing Board shall have and is hereby given all powers, duties and <br />obligations enumerated in this agreement, and all such further powers necessary to carry out the <br />intent and purpose of the Department with respect to acquisition of property and operation of the <br />Department heretofore set forth, including the following: <br /> <br />1) To employ and determine the terms of employment of administrative and other <br />personnel, accountants, consultants, legal counsel, and other qualified personnel, <br />except as provided in this Agreement. <br /> <br />2) To cause reports, plans, studies and recommendations to be prepared. <br /> <br />3) To lease or purchase equipment and supplies necessary for the proper operation, care, <br />maintenance, and preservation of Department facilities and equipment, except as <br />otherwise provided in this Agreement, and subject to the budget as approved by <br />member cities. <br /> <br />4) To adopt Department bylaws, rules and regulations for the operation, maintenance <br />and use of the Department personnel services, equipment and facilities. <br /> <br />5) To enter mutual aid agreements with other organizations with similar purposes. <br /> <br />6) To recommend disposal of capital equipment, as hereinafter defined, and land. <br /> <br />7) To provide policy and guidance for the governance of the joint powers police <br />department. The Governing Board shall have the power to appoint, promote, suspend <br />and remove officers and employees of the joint powers police department as <br />hereinafter provided. <br /> <br />8) To sell or lease any of its equipment as may be deemed expedient. <br /> <br />9) To establish a yearly budget for police services pertaining to the Department, which <br />budget shall require approval by the City Councils of each of the member cities, per <br />Section VII of this Agreement. <br /> <br />10) To act as agent for receipt, custody and disbursement of funds, gifts or other funds <br />paid or given by the contracting cities on behalf of, or, for the use of the Department. <br /> <br />11) To act as agent for any contracts of indebtedness and loans made in the names of the <br />contracting cities for the benefit of the Department. <br /> <br />12) To cause an annual audit to be made of all its accounts, books, vouchers and funds. <br /> <br />-4- <br />
