<br />City of Centerville <br />Ordinance #8 <br />Effective 12/16/82 <br /> <br />holding ponds as required by the City. The Developer shall be responsible for <br />the storm sewer cleaning and holding pond dredging, as required, by the City <br />prior to until such time that all primary buildings within the subdivision are <br />completed or two years after final acceptance of the streets by the City, which <br />ever occurs first. <br /> <br />38.01-10. SITE GRADING. The Developer shall be responsible for securing all <br />necessary approvals and permits from all appropriate Federal, State, Regional <br />and Local jurisdictions prior to the commencement of site grading. <br /> <br />38-01-11. STREET SCAPE. The Developer shall make provision that all gas, telephone <br />and electric utilities shall be installed to serve the development as per the City <br />Street Scape Plan. <br /> <br />38-01-12. GROUND COVER CONTROL. All unoccupied lots shall be maintained in <br />such a manner that ground cover will not be allowed to grow more than 24 <br />inches in height at any time. Should the Developer not respond within ten <br />(10) days to the City's request to cut the vegetation, the City shall take action <br />to do so and shall bill the Developer. If the bill is not paid in thirty (30) days, <br />the cost of the maintenance shall be a lien against the property and may be <br />certified for collection with the real estate taxes, or at the option of the City <br />Council may be deducted from the Developer's Letter of Credit. <br /> <br />38.01-13. SCREENING <br /> <br />1. The Developer shall install as a part of the site grading a protective <br />screen planting berm in areas deemed appropriate and/or necessary <br />by the City Council. <br /> <br />2. The plantings will provide a mmtmum of sixty (60%) percent <br />opacity year round and shall reach a minimum of (10) feet in height <br />at the maturity. Deciduous shrubs shall be minimum of twenty-four <br />(24) inches in height, deciduous trees shall be a minimum of one (I) <br />inch caliper, and conifer shall be a minimum of four (4) feet in <br />height at the time of planting. The landscape plan for the berm shall <br />be submitted to and reviewed by the City Forester for approval. <br /> <br />3. All planting shall be warranted to be alive, of good quality and <br />disease fee for a period pftwelve (12) month or one (I) growing year <br />which ever is greater after acceptance of the City streets and utilities. <br />The first planting replacement shall be warranted for twelve (12) <br />months from the time planting. City shall be entitled to draw upon <br />the security posted herein for replacement of any plantings. <br /> <br />4. Developer shall not enter into any agreements with the homeowners, <br />which provide for installation of the boulevard trees by the <br /> <br />Page 18 of34 <br />
