Stat. 429, K-G Development, Inc. ("K-G") hereby objects to the <br />proposed assessment on the following grounds: <br /> <br />1. Ineffective Notice: The proposed assessment provided inadequate notice for the <br />following reasons: <br /> <br />a. Owner of the Properties is Not Listed: The "benefitted" <br />properties are owned by K-G and is located at the address listed above. <br />The Notice of Assessment sent by U.S. Mail identified the wrong entity <br />at the incorrect address. Klosner-Goertz Homes, Inc. is neither the <br />owner of the properties nor responsible for the assessments. <br /> <br />b. The Notice Sent is Incomplete: The written notice did not satisfy <br />the disclosure requirements of Minn. Stat. 429.061, subd. 1. <br /> <br />2. City HaU Watermain: The proposed assessment improperly charges K-G for <br />the entire cost of the City Hall watermain when other property owners will benefit from the <br />improvement. The assessment should be adjusted to reflect the proportional benefit which will <br />be realized by others. In particular, the Eagle Pass subdivision will contain over 140 units <br />which will benefit from this improvement and are not being assessed. <br /> <br />3. Period of Assessment: The proposed assessment requires payment over five <br />years while the Development Contract Clearwater Meadows (June 10, 1996) ("Development <br />Contract") between the City and K-G requires payment over ten years (paragraph 2(c)). <br />
