June 9, 1997 <br /> To: City Council of Centerville <br /> From: Curtis and Karen Coffman <br /> 7041 Brian Dr <br /> Centerville, MN 55038 <br /> Subject: Clear Water Meadows Development <br /> Complaint against K -G Developers <br /> We are the homeowners of Lot 1, block 1 of Clear Water Meadows <br /> and are representing also the concerns of the homeowner of Lot 2 in <br /> regards to the perpetual easement of ten feet on each lot for a public <br /> walkway and trail. <br /> This easement, which was signed by the developer and the city, and <br /> is recorded in the city planners documents, had never been nor was <br /> any attempt made to disclose to the builders; M &M Homebuilders, the <br /> Realtors; Edina Realty, or the home owners; myself and my neighbor. <br /> No record has been made on any plat drawing to my knowledge, and <br /> that was confirmed by Dave Nyberg last Friday, June 6th, 1997, and <br /> also by my builder and Realtor. <br /> The easement in question came to our knowledge Thursday, June <br /> 5th, 1997 when Mr. Nyberg informed us that a survey crew was <br /> coming to stake out the path. My response to him was, "what path ?" <br /> The easement, or path in question, will travel between our two yards <br /> and leave our front and private back yards open to public viewing. We <br /> did not move to Centerville to be looked at day after day. This public <br /> walkway is a matter of privacy to my neighbor and myself. We are <br /> also concerned about the safety of our daughter playing in the yard <br /> while strangers are walking by on the path. If we had known about <br /> this easement and path, we would have never purchased the lot that <br /> our home is on now. <br /> As it is surveyed at this present time, the edge of the pathway comes <br /> to within 16 feet of the living area of our home. <br />
