or use of seeing -eye dogs by blind persons; ownership or use of companion dogs by <br /> quadriplegic, paraplegics or other individuals with sever disabilities who are unable to clean <br /> up after the companion dog; dogs when used in police activities by the City; or tacking dogs <br /> when used by or with permission of the City. <br /> Subd. 8 Written Complaint. Any person aggrieved by an animal nuisance may make a <br /> written complaint to the Police Department, or such other persons designated by the Mayor, <br /> stating the acts complained of, the name and address of the owner of the animal, and the <br /> name and address of the person making the complaint. The Police Department shall then <br /> promptly notify the person owning or keeping the animal and shall order the nuisance <br /> abated within five (5) days. If such animal nuisance is not abated within that time, a charge <br /> may be made against the owner or keeper of the animal and any person found to have <br /> violated the provisions of this Section shall be guilty of a misdemeanor. <br /> Subd. 9 Other. Any animals kept contrary to this Section are subject to impoundment as <br /> provided in Section 24.07 <br /> 24.12 Seizure of Animals. Any police officer or animal control officer may enter <br /> upon private property and seize any animal provided that following exist: <br /> (1) There is an identified complainant other than the police officer or animal <br /> control officer making a contemporaneous complaint about the animal; <br /> (2) The officer reasonably believes that the animal meets either the barking dog <br /> criteria set out in 24.11; the criteria for cruelty set out in 24.13; or the criteria <br /> for an at large animal set out in 24.02 Subd. 1; <br /> (3) the officer can demonstrate that there has been at least one previous <br /> complaint of a barking dog; inhumane treatment of the animal; or that the <br /> animal was at large at this address on a prior date; <br /> (4) The officer has made a reasonable attempt to contact the owner of the <br /> property and those attempts have either failed or have been ignored; <br /> (5) The seizure will not involve the forced entry into a private residence. Use of a <br /> pass key obtained from a property manager, landlord, innkeeper, or other <br /> authorized person to have such key shall not be considered unauthorized <br /> entry; <br /> and <br /> (6) Written notice of the seizure is left in a conspicuous place if personal contact <br /> with the owner of the dog is not possible. <br /> 24.13 Human Treatment of Animals. The owner of any animal within the City shall provide <br /> such animal with sufficient wholesome food and water on a daily basis, proper and sufficient <br /> shelter from the weather, and veterinary care when needed to prevent suffering of any sick or <br /> injured animal.
