24.18 Diseased Animals. <br /> Subd. 1 Running at Large. No person shall keep or allow to be kept on his or her <br /> premises, or on premises occupied by them, nor permit to run at large in the City, <br /> any animal which is diseased so as to be a danger to the health and safety of the City, <br /> even though the animal be properly licensed under this Section. <br /> Subd. 2 Confinement. Any animal reasonably suspected of being diseased and <br /> presenting a threat to the health and safety of the public, may be apprehended and <br /> confined in the pound by any person or police officer. The police officer shall have a <br /> qualified veterinarian examine the animal. If the animal is found to be diseased in <br /> such a manner so as to be a danger to the health and safety of the City, the officer <br /> shall cause such animal to be painlessly killed and shall properly dispose of the <br /> remains. The owner or keeper of the animal killed under this Section shall be liable <br /> for at least seventy -five dollars ($75.00) to cover the cost of maintaining and <br /> disposing of the animal, plus the costs of any veterinarian examinations. <br /> Subd. 3 Release. If the animal, upon examination, is not found to be diseased within <br /> the meaning of this Section, the animal shall be released to the owner or keeper free <br /> of charge. <br /> 24.19 Dangerous and Potentially Dangerous Animals: <br /> Subd. 1 No person shall bring into the City an animal which has previously been <br /> declared by another jurisdiction to be dangerous or potentially dangerous. The City <br /> shall seize and destroy at the owners expense any animal brought into the City in <br /> violation with the previous sentence. <br /> Subd. 2 Attack by an animal. The following provisions of the Section 24 shall <br /> apply to all animals. It shall be unlawful for any person's animal to inflict or attempt <br /> to inflict bodily injury to any person or other animal whether or not the owner is <br /> present. This section shall not apply to an attack by a dog under the control of an on- <br /> duty law enforcement officer or to an attack upon an uninvited intruder who has <br /> entered the owner's home with criminal intent. <br /> Subd. 3. Destruction of dangerous animal. The animal control officer shall have the <br /> authority to order the destruction of dangerous animals in accordance with the terms <br /> established by this ordinance. In the event the City becomes aware that a dangerous <br /> or potentially dangerous animal is owned by resident of the City, the Chief of Police <br /> shall determine whether the animal should be removed from the City, or whether it <br /> would be sufficient for the animals owner to comply with Minnesota's dangerous dog <br /> statute, Minnesota Statutes Section 347. 50.
