PUBLIC SAFETY, WELFARE AND MORALS 109D.08 <br /> paid by the owner of the affected property, after notice <br /> in writing of the costs and expenses incurred has been <br /> served on the owner of the property. If the costs are not <br /> paid by the owner within 30 days after service, the total <br /> costs and expenses incurred, plus a penalty of eight per- <br /> cent, shall be assessed against the affected ffected pro ert in <br /> property <br /> accordance with Section 109C.03 of the Municipal Code. <br /> 1090.07. PENALTY. Any person who shall fail to abate <br /> a nuisance as set forth in this Chapter, or who shall fail <br /> to comply with the provisions of any notice provided herein, <br /> or who shall resist or obstruct the Health Inspector, or <br /> his authorized representative, in the abatement of the <br /> nuisance, shall be guilty of a misdemeanor, and, upon <br /> conviction thereof, shall be subject to a fine of not more <br /> than $500.00 or imprisonment for not more than 90 days, <br /> or both. Each day on which such violation continues shall <br /> constitute a separate offense. <br /> 1090.08. SEPARABILITY. If any section, subsection, <br /> sentence, clause or phrase of this Ordinance is for any <br /> reason held to be invalid by a Court of competent jurisdic- <br /> tion such decision shall not affect the validity of the <br /> remaining portions of this Ordinance. <br /> 9/25/78 211 -20 <br />
