Effective 9/5/00 <br /> City of Centerville Ord. #4 <br /> justified by design of the development. <br /> 5. The plan will not create an excessive burden on <br /> parks, schools, streets, and other public facilities <br /> and utilities which serve or are proposed to serve <br /> the PUD. <br /> B. Non - Compliance. In the event the plan as submitted for final <br /> approval is not in substantial compliance with the preliminary <br /> development plan, the Planning and Zoning Commission shall notify <br /> the applicant within forty -five (45) days of the date of application, <br /> setting forth the ways in which the plan is not in substantial <br /> compliance. <br /> 1. The applicant may treat such notification as <br /> denial of preliminary approval; or <br /> 2. The applicant may re -file his plan so that it does <br /> substantially comply with the outline <br /> development plan; or <br /> 3. The applicant may file a written request with the <br /> Planning and Zoning Commission that it hold a <br /> public hearing on his request for final approval. <br /> Any such hearing shall be held within thirty (30) <br /> days after the request for such hearing. Within <br /> forty -five (45) days of such hearing the Planning <br /> and Zoning Commission :shall either grant or <br /> deny preliminary approval to the plan. <br /> C. Final Approval. The City Council shall review and approve the Final <br /> Development Plan if it is in substantial compliance with Preliminary <br /> Development Plan. Following this, the applicant shall record the Final <br /> Development Plan in the manner provided for recording subdivision <br /> plats. If the Final Development Plan is not in substantial compliance, <br /> the applicant shall be requested to repeat the procedures outlined for <br /> the Preliminary Development Plan. <br /> Section 180.210: Time Limit. If work on the PUD is not started within three months of the <br /> proposed schedule date after final approval has been granted, approval shall terminate <br /> unless an extension period is requested or granted by the City Council. <br /> Section 180 -220: Annual Review. The Planning and Zoning Commission shall review all <br /> PUD Districts within the City at least once each year and shall make a report to the City <br /> Council on the status of the development in each of the PUD Districts If the City Council <br /> finds that development has not occurred within a reasonable time after the original <br /> Page 53 of 62 <br />
