Motion by Council Member Sweeney, seconded by Council Member <br /> Broussard Vickers to approve the expenditures for the City from September <br /> 14, 2000 through September 27, 2000. All in favor. Motion carried <br /> unanimously. <br /> Centennial Fire District Expenses <br /> Motion by Council Member Sweeney. seconded by Council Member <br /> Broussard Vickers to approve the Centennial Fire District expenditures in <br /> the amount of $5,583.75. All in favor. Motion carried unanimously. <br /> 20 Avenue Water /Sewer Final Pay Estimate <br /> Mr. Peterson indicated the project has been completed since 1998 and the City has <br /> been withholding payment from Bonine Excavating, Inc., until several issues <br /> were resolved. Mr. Peterson stated that Ms. Nancy Bonine recently contacted him <br /> and indicated willingness to waive payment of $14,969.14 that was at issue and <br /> requested payment of the $21,288.78. Mr. Peterson recommended payment of <br /> $21,288.78. <br /> Mayor Wilharber inquired to whom the check should be made payable to. Mr. <br /> March indicated he is waiting for instruction from City Attorney Hoeft. City <br /> Attorney Hoeft noted that the City has received two (2) separate Notices of <br /> Levy's against monies owed to Bonine Excavating and the two agencies will be <br /> receiving the money in lieu of Bonine. <br /> Motion by Council Member Sweeney, seconded by Council Member Travis <br /> to approve payment of $21,288.78 as the seventh (7) and final payment on the <br /> 20 Avenue water /sewer utility im rovements. • vor._ lylotiopt carried <br /> unanimously. c a■ <br /> ( Qe , •a. U y <br /> VII. PETITIONS AND COMPLAINTS <br /> Council Member Nelson inquired as to the status of the Salazar's dogs, Nikita and <br /> Dakota. Council Member Nelson stated that she has driven past the Salazar's <br /> house and noted the pen was not in compliance with Council requirements. <br /> Mr. March reported to Council the Salazars began construction of a fence <br /> impeding the street right -of -way by one (1) foot without applying for a variance, <br /> and the City placed a stop work order on the site. Subsequent to numerous <br /> telephone conversation with Mr. Salazar, Mr. Salazar has assured Mr. March that <br /> he will keep the dogs in the house excluding relief periods. Mr. March stated that <br /> he attempted to mail a certified letter to the Salazars in regards to non - compliance <br /> of the dog kennel; however, it was not picked up at the post office. Mr. March <br /> stated he had a Centennial Lakes Police Officer serve the letter on a juvenile at <br /> Page 7 of 12 <br />
