l <br /> 13.1 Subject to performance by the Purchaser, the Seller agrees to deliver a Warranty Deed (to be joined <br /> in by spouse, if any), conveying marketable title to said premises subject only to the following exceptions: <br /> (A) Building and zoning laws, ordinances, State and Federal regulations. <br /> (B) Restrictions relating to use and improvement of premises without effective <br /> forfeiture provision. <br /> (C) Reservation of any minerals or mineral rights to the State of Minnesota. <br /> (D) Utility and drainage easements which do not interfere with present improvements. <br /> (E) Rights of tenants: (unless specified, not subject to tenancies). <br /> 13.2 The Seller certifies that the Seller does not know of any wells on the property. The Seller certifies <br /> that the Seller does not know of any private sewer system on the property. <br /> 13.3 This Contract embodies the entire written agreement between parties and cannot be waived or <br /> amended except by a written agreement executed by Seller and Purchaser; and neither party has relied upon any <br /> verbal or written representations, agreements, or understandings not set forth herein, whether made by any agent <br /> or party hereto. It is understood and agreed that this sale is made subject to the approval by the owner of said <br /> premises in writing. <br /> 13.4 The representations, warranties, and covenants of the Seller and Purchaser herein contained shall <br /> survive the Closing and shall not be merged into the Closing. <br /> 13.5 Nothing contained herein shall be construed to create a relationship between parties hereto as joint <br /> ventures or partners or to create any other relationship between parties other than that of "Seller" and <br /> "Purchaser ". <br /> • <br /> IN WITNESS WHEREOF, This Contract has been signed and sealed on the day and year first above written. <br /> SELLER: PURCHASER: <br /> Richard S.
