ARTICLE 111 <br /> Approval By Architectural Control Committee <br /> Prior to Construction <br /> 3.1 Purpose and Authority. In order to maintain the Criteria for Standards, to prevent the <br /> impairment of the attractiveness of the individual Lots and to maintain the desired tone of the <br /> residential community, and thereby secure to each Owner the full benefit and enjoyment of his Lot <br /> with no greater restriction on the free and undisturbed use of a Lot than is necessary to ensure the <br /> same advantages for the other Owners, an Architectural Control Committee is hereby established. <br /> 3.2 Membership. The Architectural Control Committee (hereinafter referred to as <br /> "Committee ") shall be composed of 1 or more individuals appointed by the Declarant, and shall <br /> remain in existence until such time as all of the Lots affected by this Declaration have been sold <br /> and residential dwellings have been constructed upon said Lots or until December 31, 2010, <br /> whichever occurs first. In the event of a death or resignation of any member of the Committee, <br /> the remaining members shall have full authority to designate a successor. Neither the members of <br /> the Committee, nor its designated representatives shall be entitled to any compensation for <br /> services performed pursuant to this covenant. At any time after all of the Lots affected by this <br /> Declaration have been sold to Owners who reside in dwelling constructed on the Lots, the said <br /> Owners of a majority of the Lots affected by this Declaration shall have the power through a duly <br /> recorded written instrument to change the membership of the Committee or to withdraw from the <br /> Committee or restore to it any of its powers and duties. Before commencing any permanent improvement on or to any of the <br /> described Lots, the Owner shall first submit a site plan and plans and specifications for the written <br /> approval of the Architectural Control Conunittee. The Committee shall not be enticed to charge a <br /> fee for review of plans. <br /> The Committee's approval or disapproval shall be within 10 days. In the event the <br /> Committee or its designated representative fails to approve or disapprove within 10 days after <br /> plans and specifications have been submitted to it, or within said 10 -day period submit the issue to <br /> arbitration as hereinafter provided, approval will be deemed granted. <br /> The Architectural Control Committee shall take into consideration the planned location of <br /> the proposed improvement, its conformity and harmony of external design with existing or <br /> planned improvements to the Property, and the location of the improvement with respect to <br /> topography and finished ground elevation. Conformity by the Owner with such requirements as <br /> may be imposed by the City of Centerville in connection with the issuance of a building permit for <br /> the Lot shall not create a presumption that such planned improvement is compatible and in <br /> harmony with the existing or planned development of other Lots.
