MEMO <br /> DATE : May 18, 2000 <br /> TO : Honorable Mayor and Council <br /> FROM : Jim March <br /> RE : Trio Inn Liquor Violation <br /> Included in your packet is a copy of the Circle Pines/Lexington /Centerville Police <br /> Department incident report on an alleged liquor violation that occurred at the Trio Inn. I <br /> have informed City Attorney Jim Hoeft in regards to this violation. I have advised Mr. <br /> Hoeft to be prepared to discuss the consequences of this violation and the options that the <br /> City may have in issuing any type of civil penalty. <br /> Mr. Hoeft indicated to me that he would not advocate a license suspension for this type of <br /> offense. Mr. Hoeft also mentioned that it might be desirable to wait to see what type of <br /> action is taken on the criminal end of this matter, prior to making a decision on the civil <br /> issue. <br /> I am only aware of one other liquor violation that has occurred at the Trio Inn in the last <br /> four years. This was on off -sale liquor violation in November of 1997. At that time, a <br /> hearing was held and a civil penalty was issued in the amount of $900. <br /> Minnesota Statute 340A.415 authorizes the authority issuing or approving any retail <br /> license or permit under the liquor control statute to either suspend for up to 60 days or <br /> revoke the license or permit or impose a civil fine not to exceed $2,000 for a liquor <br /> violation on a finding that the license or permit holder has failed to comply with an <br /> applicable statute, rule or ordinance relating to alcoholic beverages. This suspension or <br /> revocation cannot take effect until the license holder has been afforded an opportunity for <br /> a hearing. <br /> I will be in contact with Mr. Montain to inform him that this item is on the Council <br /> agenda. No formal action is required to be taken on this item at the meeting. If you have <br /> any questions, please do not hesitate to contact me. <br />
