Paul Palzer stated the pond level was dropped last year to allow for drainage. Mr. <br /> Peterson indicated he wouldn't be able to comment on this issue at this time but <br /> noted the pond was in place to remove nutrients before the water reached the local <br /> lakes. <br /> Mr. March stated there are thirty (30) ponds in the City of Centerville and a fund <br /> is in place for maintenance on ponds within the City to remove silt. He indicated <br /> a capital improvement plan needs to be created to set a time for each pond to be <br /> cleaned. <br /> Mr. March stated an organic fertilizer provider is being brought to his <br /> neighborhood to discuss the positives behind organic fertilizers and water quality <br /> of surrounding ponds. <br /> VIII. UNFINISHED BUSINESS <br /> Hunter's Crossing — Grading Plan, Draft Developer's Agreement <br /> Mr. Peterson noted the grading plan was approved at the last meeting but the draft <br /> Developer's Agreement needs discussion. Mr. March reviewed the revisions to <br /> the Developer's Agreement with the Council. He noted the only concern at this <br /> time is the contested assessments and explained the City does not want to be <br /> responsible for those four properties. <br /> Mr. Hoeft stated the developer is not going to go through with this development <br /> until the assessments are straightened out due to the fact the developer does not <br /> want to pay the full assessment amount. <br /> Council Member Nelson asked if the 429 process would protect the City from all <br /> contested assessments. Mr. Hoeft noted the 429 process would not keep the City <br /> from paying but would not have them paying the full amount of the assessment. <br /> He stated it would test the financial benefit to the development and go from there. <br /> Mr. Hoeft noted the benefit to the developer with sewer and water is large and he <br /> will go through with the development as scheduled. He explained during the <br /> assessment process, the Council should take into consideration the relative benefit <br /> to each property and how it can be spread amongst all properties involved. Mr. <br /> Hoeft noted if the developer does not want to enter into the Developer's <br /> Agreement, he would have the option of completing the improvements at his own <br /> expense. <br /> Mr. Hoeft noted no approval was needed at this time of the assessments, grading <br /> plan or Developer's Agreement. Mr. Peterson indicated the Plans and <br /> Specifications did need approval to allow for the opening of bids on this project. <br /> He reviewed the plans with the Council and asked for comments. <br /> Council Member Travis asked who would be responsible for funding services <br /> south of this development. Mr. Peterson noted this would be the responsibility of <br /> future developers. <br /> 7 <br />
