• <br /> P &Z Meeting Minutes <br /> November 2, 1993 <br /> Page Three <br /> Ordinance #4, Article 7 - DEFINITIONS. <br /> The Planning and Zoning tabled discussion of Ordinance #4, <br /> Article 7 - DEFINITIONS. <br /> Possibility of Amending Ordinance #4, Article 3. Section 34.01 <br /> GENERAL REQUIREMENTS to exclude new development plats. <br /> It was noted that the City Council at their October 13, 1993 <br /> meeting requested the Planning and Zoning Commission to consider <br /> an amendment to the previous amendment to Ordinance #4, Article <br /> 3, Section 34.01 GENERAL REQUIREMENTS. The previous amendment <br /> allows for averaging of the front yard setback if the adjacent <br /> structures have front yard setbacks different from the • <br /> requirements. The City Council expressed concern regarding the <br /> possibility of new construction being allowed to average of front <br /> yard setback by utilizing existing structures. <br /> It appeared to be the consensus of the Planning and Zoning <br /> Commission members present that the intent of the original <br /> amendment was to not include new development plats. <br /> Motion by Drilling, second by LaMotte to schedule a public <br /> hearing for the next Planning and Zoning Commission regarding the <br /> possibility of amending Ordinance #4, Article 3, Section 34.01 <br /> GENERAL REQUIREMENTS to exclude new development plats, motion <br /> carried unanimously. <br /> NEW BUSINESS: <br /> One Year Time Limit on Building Permits - Taking into <br /> Consideration some Commercial Properties may take longer. <br /> The Planning and Zoning Commission discussed the possibility of <br /> placing a one year time limit on building permits. <br /> It appeared to be consensus of the Planning and Zoning Commission <br /> members present that remodeling of the Creamery Apartments is <br /> taking some time, however the property owner appears to be • <br /> conscientious and the work being done is a substantial <br /> improvement compared to the condition of the Creamery Apartment <br /> building before the current property owner purchased the <br /> property. <br /> The Planning and Zoning Commission expressed concern that if a <br /> time limit is placed on building permits the quality of work may <br /> deteriorate. <br /> Sanna Buckbee, Assistant City Clerk, noted the City Attorney has <br /> expressed concern that a city may not be allowed to place a time <br /> limit greater than that allowed in Uniform Building Code. The <br /> City Attorney is being asked for his opinion. It was also noted <br /> the permittee signs a statement agreeing to commence the work <br /> • <br />
