Pursuant to due call and notice thereof the Planning and Zoning <br /> Commission of the City of Centerville held a public hearing on <br /> Tuesday, June 9, 1992 at the City Hall. The purpose of the <br /> hearing was to hear all persons present regarding a request <br /> for an eleven foot variance from Ordinance #4, Section 34.01-3 - <br /> "Any principal structure situated on lands contiguous to or <br /> abutting any portion of the public lakes in Centerville shall <br /> maintain yard setbacks of seventy -five (75) feet from the lake. <br /> Where adjacent structures have yard setbacks different from these <br /> requirements, the minimum setback from the lake shall be the <br /> average setback of such adjacent structures to a minimum of fifty <br /> (50) feet." The request for variance is to construct a single <br /> family home approximately thirty nine (39) feet from the lake. <br /> Chairperson Tourville called the hearing to order at 7:05 p.m. <br /> Present: Drilling, LaMotte, Vermeulen, Welk. <br /> Chairperson Tourville summarized the request for variance to the <br /> Planning and Zoning Commission and members of the audience. <br /> Steve Marcello, 1588 Peltier Lake Drive, was present. Mr. <br /> Marcello noted that he is requesting the variance to build a <br /> single family home thirty nine feet versus fifty feet from the <br /> lake. Mr. Marcello expressed that he did not feel that he would <br /> be asking for any special privileges. Mr. Marcello's proposed <br /> single family home would be built in line with the adjacent <br /> properties. Mr. Marcello has received a permit from the Rice <br /> Creek Watershed District. <br /> Chairperson Tourville asked what comments were received from the <br /> Rice Creek Watershed District. <br /> Mr. Marcello noted that the Rice Creek Watershed District <br /> appeared to feel that his request was within reason. The Rice <br /> Creek Watershed District Engineer Peter Fryer appeared to not <br /> express concern with Mr. Marcello's proposed building site. <br /> Chairperson Tourville noted that the lot is not as deep as <br /> required in an R -2 Single Family Residential - Sewered lot. The <br /> lot in question appears to be 125 feet deep. The lot was platted <br /> and deeded prior to the current zoning ordinance requirements. <br /> Mr. Marcello noted the proposed building is in compliance with <br /> all the other setback requirements (side /front). <br /> Richard Thompson, 1657 Peltier Lake Drive, was present. Mr. <br /> Thompson noted that he did not have any objections to Mr. <br /> Marcello's request to build 39 feet from the lake. Mr. Thompson <br /> expressed that his home is located approximately 40 feet from the <br /> lake. <br /> Norman Fritchie, 1637 Peltier Lake Drive, was present. Mr. <br /> Fritchie noted that his home is two lots west of the lot in <br /> question. Mr. Fritchie asked if it was the size of the lot that <br />
