ik <br /> CITY OF CENTERVILLE <br /> COUNTY OF ANOKA <br /> STATE OF MINNESOTA <br /> AMENDMENT TO ORDINANCE 044 <br /> This is an amendment to Ordinance #44 to include, after Section <br /> #5. Appeal Provisions., the following: <br /> Section #6. Variance Standards. Variances from the literal <br /> provisions of the ordinance may be granted in instances where <br /> their strict enforcement would cause undo hardship because of <br /> circumstances unique to the individual property under <br /> consideration. <br /> In considering all requests for variance or appeal and in taking <br /> subsequent action, the city shall make a finding of fact: <br /> (1) That the property in question can not be put to a <br /> reasonable use if used under conditions allowed by the <br /> official controls. <br /> (2) That the plight of the land owner is due to <br /> circumstances unique to his property not created by the <br /> land owner. <br /> (3) That the hardship is not due to economic considerations <br /> alone and when a reasonable use for the property exists <br /> under the terms of the ordinance. <br /> (4) That granting the variance requested will not confer on <br /> the applicant any special privilege that would be <br /> denied by this Ordinance to other lands, structures, or <br /> buildings in the same district. <br /> .(5) That the proposed actions will not unreasonably <br /> diminish or impair established property values within <br /> the neighborhood. <br /> (6) That the proposed actions will be in keeping with the <br /> spirit and intent of the ordinance. <br /> Sections #6,7, and 8 to be renumbered accordingly. <br /> Passed by the Centerville City Council on April 27, 1988. <br /> 1 , <br /> .& ALtttemt <br /> Clerk /Tress r -,d Mayor <br />
