Attached Garages, until all Commission members <br /> are present, motion carried unanimously. <br /> Motion by Tourville, second by Vermeulen for City Clerk to <br /> research and take appropriate action on LaMotte Drive /Mound Trail <br /> issue, motion carried unanimously. <br /> NEW BUSINESS <br /> Discussion of Moratorium on pole buildings. <br /> Motion by Welk, second by Vermeulen to send the following <br /> proposed amendment to Ordinance #44 to the City Attorney for his <br /> approval, and then make recommendation to the Council: <br /> After Section #5. Appeal Provisions., add: <br /> "Section #6. Variance Standards. Variances from the literal <br /> provisions of the ordinance may be granted in instances where <br /> their strict enforcement would cause undo hardship because of <br /> circumstances unique to the individual property under <br /> consideration. <br /> In considering all requests for variance or appeal and in taking <br /> subsequent action, the city shall make a finding of fact: <br /> (1) That the property in question can not be put to a <br /> reasonable use if used under conditions allowed by the <br /> official controls. <br /> (2) That the plight of the land owner is due to <br /> circumstances unique to his property not created by the <br /> land owner. <br /> (3) That the hardship is not due to economic considerations <br /> alone and when a reasonable use for the property exists <br /> under the terms of the ordinance. <br /> (4) That granting the variance requested will not confer on <br /> the applicant any special privilege that would be <br /> denied by this Ordinance to other lands, structures, or <br /> buildings in the same district. <br /> (5) That the proposed actions will not unreasonably <br /> diminish or impair established property values within <br /> the neighborhood. <br /> h <br />
