P &Z Meeting Minutes <br /> Page Four <br /> July 7, 1987 <br /> (the most southerly 16.5 foot parcel in question could <br /> be used by itself). <br /> NEW BUSINESS <br /> Motion by Buesseler, second by Lindgren to grant Donald Opp, 1554 <br /> Holly Drive, RR 1, Hugo a variance to Ordinance #8, section 21.05 <br /> for the changing of lot lines as described in the above public <br /> hearing, motion carried uanimously. <br /> Justification for this variance: <br /> 1. does not interfere with the purpose of the subdivision <br /> regulations in Ordinance #8, <br /> 2. lot size and set back requirements are met, <br /> 3. the variance would correct and existing problem (the <br /> nonconformity of shape of existing property lines as <br /> compared to other City lots), <br /> 4. variance results in more reasonable use of land, <br /> 5. does not leave any land locked parcels, <br /> Commission also recommends that the City Engineer review the <br /> property descriptions to make sure that they are correct before <br /> the City Council grants the variance. <br /> Discussion of the Gene Wegleitner request to rezone the above <br /> properties addressed in the above public hearing. <br /> Motion by Welk, second by Buesseler to table the rezoning request <br /> of Gene Wegleitner contingent on the City Clerk researching as to <br /> whether it is possible for the City Council to approve the <br /> rezoning of the property from residential to commercial <br /> contingent on restrictions for property use, motion carried <br /> unanimously. <br /> Clerk will also check with the attorney to see if the City <br /> Council can move on the final plat of the Wegleitner Addition if <br /> the property is not rezoned commercial at this time. <br /> Jim Lagoon of Merrill Lynch Realty and Pete Johnston, P.O. Box <br /> Forest Lake appeared before the Commission to get their feelings <br /> on a variance request to Ordinance #4 to possibly build a garage <br /> within the setbacks of 1585 Peltier Lake Drive. They feel that <br /> it is a hardship to try to sell a home with a one stall garage. <br /> Commission could not state a reason why this request is unique to <br /> this property, and expressed concern over the use of retaining <br /> walls, and possible drainage or erosion problems. <br /> Discussion of possibly changing Ordinance #8 with regard to small <br /> land swaps and minor straightening of property lot lines. <br /> Motion by Lindgren, second by Welk to table the changing P &Z <br />
