r <br /> Pursuant to due call and notice - thereof, the Planning and Zoning <br /> Commission of Centerville held a public hearing Tuesday, March 3, <br /> 1987 at City Hall. Chairman Tourville called the hearing to <br /> order at 7:05 P.M. Present: Buesseler, Welk. Absent: Lindgren. <br /> Council Liaison Laska arrived at 7:15 P.M. <br /> The purpose was to hear all persons present regarding a request <br /> for variance to split lot 11, block 2 thereby creating two 75' <br /> X 150' lots described as lot 10 and North 1/2. of lot 11, block 2; <br /> and lot 12 the South 1/2 of lot 11, block 2. <br /> Paul and Margaret Anderson currently own lots 10 and 11. Marcel <br /> Rivard owns lot 12. The intention is for the Anderson's to <br /> obtain ownership of lot 12 and South 1/2 of lot 11, block 2, <br /> on which they would ike to build a single family dwelling. <br /> Mr. Rivard will then obtain ownership of lot 10 and North 1/2 <br /> of lot 11, block 2. <br /> The main concerns expressed by commission members were: <br /> - splitting a standardsize lot (lots 10 and 11) to make <br /> a substandard size lot <br /> - setbacks would be far enough to allow good vision to insure <br /> safety on both Sorel Street and Progress Road <br /> - would this set a precident encouraging other 3 lot sections <br /> to be split similarly or was there a peculiar circumstance <br /> Clerk pointed out that there appears to be a sewer stub to serve <br /> lot 10 and an additional sewer stub located in the South 1/2 <br /> of lot 11. There appears to be no sewer stub for lot 12, thus <br /> could make this a peculiar circumstance. <br /> Motion by Welk, second by Buesseler to recommend the City Council <br /> allow the request for variance to split lot 11, block 2 thereby <br /> creating two 75' X 150' lots described as lots 10 and North 1/2 <br /> of lot 11, block 2; and lot 12 and South 1/2 of lot 11, block 2. <br /> Also, a recommendation is to be made to the City Council to allow <br /> a variance to Ordinance #4, Section 34.01 -2 requesting a 16' <br /> setback variance off Sorel Street to accommodate the 44' house <br /> width and side yard setback. Motion carried unanimously. <br /> Required standard for variances seem to be met for split: <br /> 1.) Existing Special Circumstances- There is no sewer stub <br /> to serve lot 12 as it is now. A sewer stub does exist in <br /> lot 10 and the South 1/2 of lot 11. When split lot 10 <br /> and North 1/2 of lot 11, block 2, and lot 12 and South 1/2 <br /> of lot 11, block 2, would each be served by a sewer stub. <br /> 2.) Literal Interpretation of Provisions- There are other <br /> substandard lots in Centerville. Lot 12 being a 50' <br /> X 150' corner lot and having no sewer stub, would be <br /> difficult to build a single family dwelling on complying <br /> with setback requirements. The split does not increase <br /> or decrease resident density. <br /> 3.) Special Privileges- Other variances have been granted for <br />
