r <br /> Pursuant to due call and notice thereof, the Planning and <br /> Zoning Commission of Centerville held a public hearing on <br /> August 5, 1986 at City Hall. Chairman Tourville called the <br /> hearing to order at 7:05 P.M. Present: Murray, Buesseler, <br /> liaison Wilharber, councilman Robischon. Commission member <br /> Lindgren arrived at 7:25 P.M. Absent: Welk. <br /> The purpose was to hear all persons present regarding a <br /> variance request to separate lots 1 & 2, excluding the North <br /> 10 feet of lot 2, block 5; from the South z of lot 11 and <br /> all of lot 12, block 5, Village of Centerville. If separated <br /> these lots would be less than the 20,000 square feet minimum <br /> required in a commercial zone. <br /> Members of the audience expressed their opinion on this <br /> matter: <br /> Judy Helin, Lake Aires Real Estate <br /> Carl Peters, 355 South Lake Street, Forest Lake <br /> Ed Kunz, 7056 Centerville Road <br /> No one in the audience expressed opposition to this request. <br /> This request seems to meet the four criteria needed to grant <br /> a variance. <br /> 1. Existing special conditions peculiar to the land are <br /> as follows: <br /> - there is a sewer stub for each piece of property <br /> - these are old lots of record. <br /> - this separation would be concurrent with the <br /> existing downtown setting. <br /> 2. Literal interpretation would deprive the petitioner <br /> of rights commonly enjoyed by other properties in the <br /> same commercial downtown area also of this smaller size. <br /> 3. Granting the variance request will not confer on the <br /> applicant any special privilege as there are already <br /> others of this size in the downtown area. <br /> 4. This variance request will not impair the public <br /> health, safety or welfare of the residents of the city. <br /> Motion by Murray, second by Lindgren to recommend the City <br /> Council approve the variance request to Ordinance #4, section <br /> 42.02, to separate lots 1 & 2, excluding the North 10 feet <br /> of lot 2, block 5; from the South z of lot 11 and all of <br /> lot 12, block 5, Village of Centerville, motion carried <br /> unanimously. <br /> Motion by Buesseler, second by Murray to adjourn hearing. <br /> Hearing adjourned at 7:55 P.M. <br /> Respectfully submitted, 1 <br /> Debra Gonsior <br /> Clerk /Treasurer <br />
