r <br /> Page Four - Planning and Zoning <br /> Meeting Minutes <br /> June 3, 1986 <br /> Members of the audience expressed their opinion on this matter: <br /> Richard Kinning, 7059 Progress Road, Centerville <br /> Walter Kuchinski, 1724 Heritage Street, Centerville <br /> Mrs. Ken Salin, 1716 Heritage Street, Centerville <br /> Marcel Rivard, 7072 Progress Road, Centerville <br /> Harvey Cartier, 7048 Progress Road <br /> Motion by Murray, second by Lindgren to recommend the <br /> City Council deny the variance request for a two family <br /> dwelling due to the size of the lot, motion carried unanimously. <br /> Required stafdards for variances do not seem to be met: <br /> 1. The construction of a two family dwelling is a <br /> result of the actions of the petitioner, not <br /> special conditions or circumstances existing <br /> which are peculiar to the land. <br /> 2. Literal interpretation would not deprive the petitioner <br /> of rights enjoyed by others. <br /> 3. The would grant a special privilege denied to <br /> others. <br /> 4. Residents are concerned with safety of cars for <br /> two families in that small area. <br /> Motion by Buesseler, second by Murray to recommend the City <br /> Council allow a variance to Ordinance #4, Section 34.01 -2 <br /> requesting the setback off the south property line (off <br /> Heritage Street) be no closer than 16 feet to that property <br /> line to allow construction of a single family home, <br /> motion carried unanimously. <br /> Required standards for variances seem to be met: <br /> 1. Special circumstances and conditions exist as <br /> this is a 50' x 150' lot of record. <br /> 2. Literal interpretation would deprive the petitioner <br /> of rights enjoyed by others as the City has granted <br /> such variances in the past. <br /> 3. Granting this variance request will not confer <br /> special privileges as similar variances have been <br /> granted in the past. <br /> 4. The proposed variance will not impair property <br /> values, public health, safety or welfare of the <br /> residents of the City. <br /> Hearing adjourned at 9:20 P.M. <br /> Chairman Tourville reconvened the regular Planning and Zoning <br /> meeting at 9:21 P.M. <br /> Discussion of commission member Buesselers progress with <br /> Ordinance #4. He will get a copy of the rough draft to the <br /> Clerk for distribution to Planning and Zoning members. <br />
