C..:V . vc <br /> LEASE AGREEMENT <br /> PINEVIEW PARK BMX BICYCLE TRACK <br /> This Lease Agreement, entered into by and between the City of St. Cloud, <br /> Minnesota, a municipal corporation under the laws of the State of Minnesota, <br /> hereinafter called "Lessor" and St. Cloud Pineview Park BMX, Inc., a Minnesota non- <br /> profit corporation, hereinafter called "Lessee ": <br /> 1, Description of Leased Premises. The Lessor does hereby lease to the lessee <br /> approximately 1.6 acres of land located in Pine View Park, City of St. Cloud, Stearns <br /> County, Minnesota, as depicted an the attached Exhibit A. <br /> 2. Term of Lease. The term of this Lease shall commence on January 1, 1999, <br /> at 12:01 a.m., and shall end December 31, 2001, at 11:59 p.m. Rent shall be at the <br /> rate of One and No /100ths ($1.00) Dollar to be paid on or before the 1st day of <br /> January, 1999, and In annual Installments due on or before January 1 of each year <br /> following. This Lease may be extended by the parties beyond the original term <br /> contemplated herein upon terms and conditions to be negotiated by the parties. <br /> This Agreement may be terminated by either party, upon ninety (90) days' <br /> written notice to the other party of their Intent to terminate the Lease. Any holding <br /> over by Me Lessee on the expiration of the term of this Lease shall not be construed <br /> as a renewal thereof, but shall constitute only a tenancy on a month to month basis. <br /> 0. voagations ana Yrrvaeges OT Lessee. <br /> A. Nature of Operations. The Lessee agrees that it will utilize the leased <br /> premises for purposes of constructing and maintaining a BMX Bicycle Track, <br /> together with services associated thereto, and will not engage in any other <br /> business or activities within the confines of the leased premises other than <br /> those expressly authorized by the Lessor, nor will it engage in any unlawful <br /> activities. Lessee will comply with all conditions of Section 236 of the St. <br /> Cloud City Ordinances entitled Park and Recreation Conduct and Use <br /> Regulations. If Lessee desires to operate a concession upon the leased <br /> premises, they may do so after first having obtained written permission from <br /> the Parks Director. Lessee's desired scheduled use of the leased premises shall <br /> be submitted on an annual basis to the Recreation Director, who shall <br /> coordinate use of the park and park shelter so as not to permit conflicts in the <br /> scheduled use of the park premises. Any disputes arising out of the proposed <br /> use of the leased premises as opposed to the use of the Park premises by the <br /> public or any other organization shall be settled and resolved by the Park <br /> Director, and such determination shall be binding upon the Lessee. <br /> B. Lessee's Personal Property. The Lessee shall, at its own expense, construct <br /> an exterior fence surrounding the leased premises, including the area containing <br />
