Lessee may install locks on <br /> the entry of the interior fence only, and the BMX bicycle track shall be utilized <br /> exclusively by the Lessee. The location and materials to be used in <br /> construction of the fences must be approved by the Parks Director before <br /> installation. The Lessee, at its sole expense, shall construct the BMX track, <br /> however, the design and location of the track shall first be submitted for <br /> approval to the Parks Director. The Lessee shall obtain prior written approval <br /> of the Parks Director before installation of any other equipment requiring new <br /> electrical or plumbing connections or changes to the leased premises as of the <br /> date of occupancy under the terms of this lease. Any such changes shall be <br /> at the Lessee's expense. <br /> C. Maintenance of Premises. The Lessee agrees to assume full responsibility <br /> of the maintenance of the leased premises at its own costs and to faithfully and <br /> fully maintain the premises and all fixtures, equipment and other property <br /> located on the leased premises in a good condition and state of repair during <br /> the entire term of this Lease, or en extension thereof, end to restore the <br /> premises to the Lessor in the same condition as received, reasonable and <br /> ordinary wear and tear excepted, and to remove all improvements, including the <br /> track, fencing and seating facilities. Lessee shall bear at its own expense all <br /> costs of maintenance including, but not limited to, lawn care and landscaping <br /> maintenance, and removal of rubbish end debris. <br /> D. Util Lessee agrees to pay costs of all utilities, and shall pay all costs <br /> of arbage end refute re..+n.,al In t-e ev�nt «Fn 1 failz rn pay ,+ ny utility <br /> bill when due, Lessor may, at Its option, pay the same and collect from the <br /> Lessee the amounts disbursed, in addition to any rents that have accrued. <br /> E. Leasehold Improvements. Lessee may construct or otherwise make <br /> improvements to the premises upon submitting a written proposal of the project <br /> to the Lessor and receiving approval by the Parks Director. Said improvements <br /> must be consistent with the construction and maintenance of a BMX bicycle <br /> track, and shall be attached hereto as Exhibit B. <br /> P. Insurance. Lessee shall obtain liability Insurance for both personal Injury and <br /> property damage. The Lessor shall be named as an additional insured under the <br /> terms of this policy. The Lessee shall provide a certificate of insurance on the <br /> Lessor's approved form which verifies the existence of the insurance required <br /> under this Agreement. Any policy obtained and maintained under this clause <br /> shall provide that it shall not be cancelled, materially changed, or not renewed <br /> without thirty (30) days' prior written notice thereof to the Lessor. <br /> Prior to January 1, 2000, the minimum limits for to Lessee's liability insurance <br /> shall be in the amount of Three Hundred Thousand and No /100ths <br /> (5300,000.00{ Doaars singe limit coverage with a Seven Hundred Fifty <br /> aw,ern,�OMB -0709 2 <br />
