After January 1, 2000, the minimum limits for the <br /> Lessee's liability insurance shalt be in the amount of Three Hundred Thousand <br /> and No /100ths (9300,000.00) Dollars single limit coverage with a One Million <br /> and No /100ths 051.000,000.00) Dollars aggregate. All coverage shall be on <br /> an occurrence basis. <br /> Lessee shall additionally obtain worker's compensation insurance extending <br /> coverage to all of its employees. <br /> The parties hereto shall be liable for their own acts and negligence and each <br /> agrees to Indemnify the other for any losses, damages, costs or expense, <br /> including litigation expenses paid or sustained by reason of the act or <br /> negligence of the other, <br /> G. Rights of Inspection. The Lessor reserves the right to inspect the leased <br /> premises and equipment at any reasonable time and interval for any purpose <br /> consistent with the rights as Lessor. In addition, the Lessee shall permit <br /> Inspection by employees of the Lessor consistent with inspections necessary <br /> for the licensing or permitting of any activity by the Lessee. <br /> H. Data Practices. All data collection, created, received, maintained, or <br /> disseminated for any purposes by the activities of the Lessee because of this <br /> Lease is governed by the Minnesota Government Data Practices Act, Minn. <br /> Stat. Chapter 13 as amended, the Minnesota rules implementing such act now <br /> in force or as adopted, as well as Federal Regulations on Data Privacy. <br /> 1. Independent Contractor. Nothing contained in this Agreement is intended <br /> or should be construed as creating a relationship of co- partners or joint ventures <br /> with Lessor. No tenure or any rights or benefits, including worker's <br /> compensation, unemployment compensation, meoiwal care, sick leave, vacation <br /> leave, severance pay, PERA, or other benefits available to Lessor's employees <br /> shall accrue to Lessee or its employees who perform services during the term <br /> of this Lease. <br /> J. Non - Discrimination. During the performance of this agreement, Lessee <br /> agrees to the following: <br /> No person shall on the grounds of race, color, creed, religion, national <br /> origin, sex, marital status, status with regard to public assistance, <br /> disability, sexual orientation or age be excluded from the full employment <br /> rights in, participation in, be denied the benefits of or be otherwise <br /> subjected to discrimination under any and all applicable Federal and State <br /> laws against discrimination. <br /> aroxcrvn. saa7m 3 <br />
