Nyberg stated <br />that many of the issues are minor. <br /> <br />What is going to happen in the south west comer? Units on the east boundary, beyond the <br />wetlands need to be or could be included in the plat. <br /> <br />The right of way needs to be shown for the exception property near the entrance on the <br />west. <br /> <br />Nyberg suggested the preliminary plat be approved with contingencies. <br /> <br />Discussion occurred on the north boundary abutting Tourville's property, the road would <br />come through and go out to the west in the future. Covenants would be written so that <br />the 4 units could join the association in the future. The road is beneficial by abutting the <br />property line so that the future Tourville development could access the streets. <br /> <br />No problem on grading plan according to Mr. Gorem. <br /> <br />Trails through backyards is an issue. Trails should not run through a corridor, maybe need <br />to run to the road. The trail could be re-routed to include sidewalks along south loop to <br />the east to hook up to Clearwater Meadows. <br /> <br />Tourville mentioned he feels over a barrel. Would his property be assessed? No, not until <br />units would be built and then utilities would be put in. <br /> <br />Tourville would like to reserve the right to review the by laws affecting homes on his <br />property. This doesn't appear to be a problem as long as they know what language he <br />would require. <br /> <br />Wilharber stated the Fire Chief has concerns on the narrow private roads being 20 foot <br />wide. Convenants could address parking on one side only. <br /> <br />Is there off street parking in association areas? Yes, 15-16 along private streets. <br /> <br />MOTION by Drilling, second by LaMotte to approve the plat contingent upon the <br />engineer's comments on letter dated July 8, 1996, being satisfied to the City Council's <br />. satisfaction, including trail and traffic consideration with street realignments being <br />possible. Motion carried unanimously. <br /> <br />Rezoning of the Hensel Property <br /> <br />MOTION by Drilling, second by LaMotte to deny the rezoning request for the Hensel <br />property based on the access, traffic flow, and design.
