<br />Planning and Zoning Meeting Minutes of March 19, 1996 <br /> <br />What are the state requirements? -- How are inspections done? -- What is the cost of the <br />inspection? <br /> <br />Staffwill gather more information and return to P&Z when it has been obtained. <br /> <br />PUBLIC HEARING <br /> <br />The public hearing on the preliminary plat for Clearwater Meadows was called to order at 7:25 <br />p.m. <br /> <br />Rockey Goertz stated that the main difference in the preliminary plat from the first one shown to <br />the commission is the realignment of the southern portion. Goertz also presented a colored map <br />showing the retention ponds that would hold water and those that won't. <br /> <br />Mike Johnson, 7046 Brian Drive questioned the drainage and utility easement for lot 21 and also <br />mentioned that his driveway will still be over the property line by 2 feet. Goertz responded that if <br />they would move the property line over any further a variance would be needed for that lot -- it <br />would not meet the city ordinance requirements. <br /> <br />The Johnson's home would still meet the set back requirements of the ordinance. <br /> <br />Kathy Johnson stated that the property was obviously sold to them fraudulently. Although the <br />preliminary plat offers them a better resolution than the previous plat she still is disappointed. <br /> <br />Goertz stated that the ditch behind the homes on the east side of Brian Drive would be regraded <br />and the trees on his property would come out. It will be a wide swale easement. <br /> <br />Gerry Peterson, 7080 Brian Drive agreed with Dan Tourville when he stated that the trees are so <br />grown up that if they are not disturbed there would be little or no erosion. Mr. Peterson stated <br />that the ditch is currently 3-3.5 feet deep. <br /> <br />Kevin Fogerty, 7088 Brian Drive questioned the drainage flow. Goertz confirmed that it would <br />be further east in the regraded swale area. <br /> <br />Tourville stated that the berm area would still be included but would be on private property. <br />Goertz confirmed that and switched the focus to the retention ponds. The retention pond to the <br />north would be used for storm water and would flow out at a certain level that would be lower <br />that the basement levels. <br /> <br />This pond would be owned by the property owner and would be noted on the deed that they <br />cannot fill it in or build with that area. <br /> <br />Goertz stated that he should have a grading plan approved by RCWD for the city counc~ meeting <br />next week. <br /> <br />PZ3-19MM.WPS <br /> <br />2 <br />
