Planningand Zoning Commission <br />May 4, 2004 <br />Meeting Minutes <br />Chair Hanson closed the public hearing at 6:45 p.m. <br />Motion by Commissioner Wilharber, seconded by Commissioner McLean to <br />recommend approval of the lot split request contingent upon application and <br />approval of the rezoning as discussed. All in favor. Motion carried unanimously. <br />III. APPEARANCES <br />None. <br />IV. OLD BUSINESS <br />1.Mr. Joel Swenson – 7016 Brian Court – Shed Extension – Drainage/Utility <br />Easement <br />Mr. Swenson addressed the Commission and explained that his yard is very wet and he <br />would like an extension to move the shed or, if at all possible, permission to leave the <br />shed in its existing location within the drainage easement but move it to comply with the <br />setback requirements. <br />Mr. Wilharber indicated that the shed is in a good location in the yard and, if the water <br />were to get as high as the shed, the houses in the area would be flooded. He then said <br />that it is sometimes necessary to approve variances because not all situations fit the code <br />requirements. <br />The Commission discussed the situation with Mr. Swenson, including his drainage <br />problems alleged to have been caused by the neighbor, and determined that there is not a <br />way to allow the shed to remain in its present location. <br />Mr. Swenson indicated that, if the shed cannot remain where it is, he would like an <br />extension until the ground dries out or freezes to make moving the shed easier. <br />Motion by Chair Hanson, seconded by Commissioner Wilharber to recommend to <br />Council allowing an extension of time to move the shed to a proper location. All in <br />favor. Motion carried unanimously. <br />V. NEW BUSINESS <br />None. <br />VI.
