City Council Meeting Minutes <br /> 7une 13, 2001 <br /> Council Member Capra asked Mr. March to make sure that Ms. Baron has all the <br /> information from her folder. Mr. March agreed to do so. <br /> Ms. Baron indicated she had intended to ask for a second inspection. - <br /> Council Member Capra asked if residents are usually present for inspections. <br /> Mr. March noted that, in reviewing the Barons' file, he discovered the City has sent out <br /> 11 notices in regards to ordinance violations over the last 13 years. He noted there were <br /> more prior to his arrival the City. He then noted that Mr. Palzer and an officer viewed the <br /> property from the street because Mr. Palzer had called twice to scheduie the inspection <br /> and was unable to reach the Barons. He further noted that when the of�cer viewed the <br /> property, it was at his discretion whether or not to issue the citation and he felt the <br /> citation should be issued. <br /> Ms. Baron questioned the City's intent regarding the 40 (forty) residences on the list she <br /> had provided. <br /> Mr. Hoeft stated that, if Ms. Baron desires to make complaints against the 40 (forty) <br /> residences, then the information would be forwarded on to Mr. Palzer or an officer to <br /> view the properties. '� <br /> I <br /> Ms. Baron indicated she is concerned that she and her husband are not being treated the �� <br /> same way as any other citizen in the community. She then noted that, if it is not okay for � <br /> them, it is not okay for the other properties. I <br /> I <br /> i <br /> Mayor Swedberg questioned the period of time the Barons would have to resolve the � <br /> matter prior to going to court. i <br /> i <br /> Mr. Hoeft explained that there is an ample amount of time between the issuance of a �, <br /> citation and the start of a jury trial. ' <br /> Council Member Capra questioned the possibility of resolving the matter prior to going <br /> to court. She then questioned who would determine what resolution would be required. <br /> Mr. Hoeft indicated that, if at this point in time the Barons have a proposal for bringing <br /> the property into compliance, they should propose it to his office either before their first <br /> appearance, at the appearance, or after the appearance. He then noted he wouid forward <br /> the proposal to Mr. March for Council consideration and, if the proposal is adequate, the <br /> action would be suspended. <br /> Mr. Hoeft indicated that he would not receive any information on the file until the first <br /> �� appearance. He then noted it might be possible to obtain information from Mr. March if <br /> the Barons wished to discuss the matter prior to the first appearance. <br /> Ms. Baron indicated it would be helpful to them to know what the problem was. <br /> Page 10 of 25 <br />
