<br />IlliSOLUTION VACATING C~RTAIN STR~~T AND <br />UTILITY EA~~TS <br /> <br />WHEREAS, a majority of the owners of property abutting on the <br />street and utility easements described below have requested <br />the City Council in a petition dated the 13th day of August, <br />1981, to vacate such street and utility easements according <br />to law; and <br /> <br />WHEREAS, a public hearing was held on September 23, 1981, <br />before the City Council in the City Hall on such petition <br />after due published and posted notice had been given by the <br />Clerk on September 10 and 17 and all persons interested <br />were given an opportunity to be heard; and <br /> <br />WHEREAS, it appears that it will be for the best interest <br />of the City to approve such petition, <br /> <br />NOW. THEREFORE, B~ IT R~SOLV~D, that such petition is hereby <br />granted and the street and utility easements described as <br />follows are hereby vacated I <br /> <br />A pennanent easement and right-of-way for the purpose of <br />installation, inspection, repair and maintenance of a sani- <br />tary sewer system, including but no t limited to, the laying <br />of pipe, installing manholes, and other appurtenances for <br />a sanitary sewer system, over that part of the following <br />described parcell <br /> <br />PARCEL A. <br /> <br />That part of Lots 6, 8 and 9, AUDITOR'S SUBDIVISION NO. 47, <br />Anoka County, Minnesota which lies within a 40 foot strip <br />of land 20 feet on each side of the following described line I <br />Beginning at the Northeast corner of Lot 10, said Auditor's <br />Subdivision No. 47; thence on an assumed bearing of North <br />89 degrees, 22 feet 44 inches West along the North line of <br />said Lot 10, a distance of 296 feet; thence Westerly 195.95 <br />feet along a tangential curve convace to the North having a <br />radius of 398.17 feet and a central angle of 28 degrees, <br />11 feet, 48 inches; thence Westerly 195.95 feet along a <br />reverse curve concave to the South having a radius of 398.17 <br />feet and a central angle of 28 degrees 11 feet 48 inches; <br />thence North 89 degrees 22 feet 44 inches West and tangent' <br />to said reverse curve a distance of 650 feet; thence North <br />o degrees 37 feet 16 inches East 30 feet; thence Northerly <br />along a tangential curve concave to the West having a radius <br />of 175 feet, an arc distance of 110 feet, more or less, to <br />the Southeasterly line of Tract "D", Registered Land Survey <br />No.5 and there tenninating. <br /> <br />A permanent easement for road and utility purposes over the <br />following described parcell <br /> <br />PARCEL"BI <br /> <br />That part of Lots 6, 8 and 9, AUDITOR'S SUBDIVISION NO. 47, <br />Anoka County, Minnesota which lies within a 60 foot strip <br /> <br />
