<br />LJ <br /> <br />RESOLUTION 12-77 <br />RESOLUTION DIRECTING CONDJItlNATION <br /> <br />WHEREAS, it iB necesBary, advisable and in the public intereBt <br />that the City of Centerville constru'ct a new sewage dis~08al <br />sYBtem; and <br /> <br />WHEREAS, in order to accompliBh Buch purpose it is necessary <br />to acquire a permanent and temporary eaBement over a certain <br />~ortion of Lot 12, Auditor'B Subdivision #47 ReviBed (Ex 12150) <br />lEx #2160) owned by Roy J. LeRoux and Louise M. LeRoux. and <br /> <br />WHEREAS, the City haB offered to purchaBe such land from the <br />owner at a price deemed by the Council to be favorable. and <br /> <br />WHEREAS, the owner of Buch land haB refuBed to accept the <br />offer; and <br /> <br />WHEREAS, by reason of such refuBal to Bell the easement above <br />deBcribed to the City, it has become necesBary to procure <br />title to such easement by right of eminent domain. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the City of Centerville <br />proceed to procure title to an eaBement in Buch land under <br />itB right of eminent domain and that the City attorney be <br />and he hereby is directed to file the necesBary petition <br />therefore and to proBecute such action to a BucceBsful con- <br />clusion or until it is abandoned, dismissed or terminated <br />by the City or by the Court; that the City attorney, the <br />Mayor and the clerk do all things necessary to be done in <br />the commencement, prosecution and BucceBsful termination <br />of such action. . <br /> <br />Adopted by the City Counc~l this 26th day of January, 1977. <br /> <br />~tu-~~tYJ ~ <br />A TER PRACHAR, MAYOR <br /> <br />~ <br />(- /. ..- .
