<br />RESOLUTION #1-77 <br />RESOLUTION DIRECTING CONDEMNATION <br /> <br /> <br />WHEREAS, it is necessary, advisable and in the public interest <br />that the City of Centerville construct a new sewage disposal <br />system; and <br /> <br />WHEREAS, in order to accomplish such purpose it is necessary <br />to acquire a permanent and temporary easement over a cer.tain <br />portion of Lot ), Block 1, LaMotte's First Addition owned by <br />Roy Richard Baber and Karen F. Baber; and <br /> <br />WHEREAS, the City has offered to purchase such land from the <br />owner at a price deemed by the Council to be favorable; and <br /> <br />WHEREAS, the owner of such land has refused to accept the <br />offer; and <br /> <br />WHEREAS, by reason of such refusal to sell the easement above <br />described to the City, it has become necessary to procure <br />title to such easement by right of eminent domain, <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the City of Centerville <br />proceed to procure title to an easement in such land under <br />its right of eminent domain and that the City attorney be <br />and he hereby is directed to file the necessary petition <br />therefor and to prosecute such action to a successful con- <br />clusion or until it is abandoned, dismissed or terminated <br />by the City or by the Court; that the City attorney, the <br />Mayor and the clerk do all things necessary to be done in <br />the commencement, prosecution and successful termination <br />of such action. <br /> <br /> <br />. <br /> <br />Adopted by the City Council this 12th day of January, 1977. <br /> <br /> <br />ATTEST. <br /> <br />CLERK-TREASURER <br /> <br /> <br />. <br /> <br />I <br />l <br />LJ <br /> <br />~ <br />'-- <br />
