Mr. Gardner then presented an application for a Special Use Permit from Mr. Lanny Boyer and the <br />Planning Commission's findings and recommendations, a copy of which is attached hereto as Exhibit "B". <br />Mr. Gardner indicated no one appeared at the Planning Commission meeting on Mr. Boyer's behalf and no <br />one was present at these proceedings representing Mr. Boyer's interests. Mr. Gardner stated that the Planning <br />Commission once again reviewed this matter which has been ongoing for nine (9) months following findings. <br />by the Zoning Administrator that lead to citations. Following significant discussion and upon motion duly <br />made (Birkebak) and seconded (Kunin), the Application from Boyer was unanimously denied based upon the <br />following which is included as part of the motion: 1) Item I.B. of Attachment to the Application requests <br />limited open storage of "junk" (non -operable) vehicles requiring major repairs to make them operable as <br />defined in Ordinance No. 43 which is in direct violation of Ordinance. No. 43, Section 14.3(2); and, 2) Item <br />IV. B. Would allow use of the property as an Open Sales Lot which requires a separate Special Use Permit <br />in accordance with Ordinance No. 43, Sections 19.3 (1)(d; 2c);;and, 3) enforcement and inspection costs of <br />the temporary storage of non -operable vehicles would exceed the scope and ability of the City's staff and <br />budget. As a result of the action, the City Prosecutor is to be advised that Boyer shall be notified of the <br />Council's decision. Further, the Prosecutor shall proceed with prosecution of violations of Ordinance No, <br />43 previously initiated. <br />Discussion of the continuing development of the Comprehensive Municipal Plan followed with no <br />action taken.. <br />Mr. Birkebak thenreported on the activities of the Contract Law Enforcement. Group noting <br />significant increases in budget to Gem Lake as the direct result of calls for service. Mr. Magnuson indicated <br />that analysis by the City Clerk indicates a high percentage of calls for service are VIN checks by motorcycle <br />and auto dealers and that a method of charging for this service which has commercial benefits must be <br />developed. As these types of business are also high profile targets for theft, many alarms are also a part of <br />the calls for service. A copy of the proposed budget shall be retained in the Police files of the City Clerk. <br />Mr. Magnuson then presented a letter from Mr. Wynne of Wynne's Rubbish & Recycling related to <br />rate changes for curbside recycling. Citing significant increases in regulations and costs which include paying <br />to dispose of newsprint, Wynne asks fora rate change to $210 monthly. A copy of the letter is to be retained <br />in the Wynne's file. <br />Mr. Magnuson then reported on the transfer of cable TV ownership to US West with no action taken. <br />Mr. Magnuson then requested that the City Council set a Public Hearing to be held on 17 June 1996 <br />for roadway improvements on Big Fox Road, Little Fox Lane, Tessier Road and Haven. Lane and assessments <br />related thereto. The date was unanimously approved. <br />Mr. Magnuson then presented Ramsey County Public Works' request for tree trimming at Goose <br />Lake Road & Haven Lane southbound, County Road E and. Big Fox. Road southbound, and Goose Lake <br />Road and Tessier Road southbound. Mr. Magnuson indicated that a professional tree trimming service should <br />be engaged to provide the work. <br />Mr. Magnuson then reported on speed management on Otter Lake, Goose Lake and Scheuneman <br />Roads with no action taken. <br />After discussion and upon motion duly made (Nielsen) and seconded (Kunin), acquisition of Ayde <br />tax forfeited lands in the amount of $1,082,80 was unanimously approved. <br />
