CITY OF GEM LAKE <br />MINUTES OF CITY COUNCIL MEETING <br />APRIL, 2001 <br />The April, 200 I meeting of the City Council Oldie City of Gem Lake was called toorder by Mayor Bineott on Monday, 16 <br />April 200 I, at 703 p.m. in the first floor meeting room of'1'inisley Pohl. Mayor Eineott, Council Members Bosak and Birkebak, <br />Prosecutor Mesiow, and Clerk Magnuson were preserri. Also present were residents Lorenz (2), Watson (2), Herzog (1), Bo1fing, <br />Lindner, and Brown. <br />Following Mayor Eineott's request for additions. deletions, or corrections, the following wore unanimously approved: 1) the <br />19 March 200I City Council Minutesas presented on Motion h\ Bosak and Second by Birkebak; 2) the 16 April 2001 City <br />Council Agenda as presented on Motion by .Birkebak and Second by Bosak. <br />•Magnuson. then presented General Announcements. <br />Emeottthen reviewed activities offthc. Planning oiiimssion, noting specifically;that further discussion ofthe proposed animal <br />control oi'diri lace had been. held with a more friendly draft developed by 1..indner. Meslow was then recognised arid discussed how <br />anitttal control ordinances are handled in other eoniIllunities, He stated that while certain issues are' clear eta (e.g. biting dogs, <br />roaming at large, etc) and can be dealt with pi'iiceduraliy, other issues like barlcing are terribly subjective as to provocation, <br />duration, intensity,. etc: The latter (barkiiig:) is iln issue; judges of the court do not like to deal with as they are insignificantrelative <br />to perceptions of crane and outer issues. Meslow siated the city can proceed one of three ways: I) do nothing and utilize the <br />existing ordinance in conjunction with tlre.nuisance ordinance: or 2) enact a tougher ordiIlailce and not enforce it (which is what <br />most cities do), orii) enact a tougher ordinanceand attempt to ent.orce same. As prosecutor, Meslow will not attempt to prosecute <br />the grey areas of clog barking.'I'be council thanked him for his input. <br />Magnuson reported thatadVei'tisenleiits for the vacant Nielsen and Treasurer's posit ions appeared in the 1 1 Apri12001 edition <br />ofthe White. Bair Press. No responses were received. althrugll Jim Segerntark called and indicated he felt Ms. Cobian was ideal <br />as Treasurer given her experience and the tactshe Works with the Clerk. Following discussion of candidates for the:. Nielsen City <br />Council seat and upon motion by Birkebak and second hBosak, Resolution No. 2001-12:, a copy of which..is attached hereto as <br />Exhibit. "A". appointing Chuck Watsnil to the Nielsen vacancy lar a term coding. on 31 December 2002. was unanimously <br />approved. Mayor Enleott administered the Gatli of .Office, attached hereto as Exhibit "B"., and welcomed Mr. Watson to the <br />Cohincll- <br />Discussidti of Resolution No. 200 I- 13 regarding Mrs. Cobian's permanent appointment was delayed to allow more time for <br />applicants to respond. ~ <br />Birkebak presented his law enittieenhent report stating titat costs lor2002 imiy increase as much as 7%. He. also reported. the <br />Smart Cart LvilIbe ready inthenext few: days ibr use. Magnuson reported he has already requested same .nor Scheunernan Road. <br />The.Recycling Report for the I `'. He will also discuss <br />street sweeping with Mr. lungnlan. <br />Magnuson iepoited he has spoken with iylayasich who liar proposed a meeting with Ken Heider, the new director of public <br />works for the county. Similarly a nleetrtlg \vit11 Mr, Soler regarding the (01111t', 1:, / Lal3ore Road project will be scheduled. <br />Biheott.repuried he has spoken with some neighbors regarding sewer and there is seine interest along with Gem Lake Hills. <br />Magnuson reported Water Invitations for proposals.11ave h.eeil.sent. <br />Magnuson preseiited a Sta ff Policy Hecoitl€iteridaticrii regarding.
