Mr. Rafferty was then introduced. He indicated Mr..Hoeschler. had requested he join the Planning.Coinmission and <br />he had consented. He gave a brief biographical sketch and responded to questions from Council.. Motion by Bosak, <br />Second by Watson to confirm Mr. Rafftery's appointment and to thank him For his willingness to commit to the <br />community was unanimously approved. <br />Motion by Watson, Second by Rasmussen to adopt Resolution No. 2005.1.2 granting a variance from: Ordinance <br />No. 43, Section 19.5(1) of five (5') feet to a. set -back of five (5') feet along the entire south side yard. of Summit Mini <br />Storage based upon an application received from Mr. Osterkamp was unanimously approved. <br />Motion by Schilling, Second by Bosak. to adopt Resolution No, 2005-09 approving amendment of the contract with <br />Belair .Excavating for Public Improvement. Project No. 2004-01 to provide .a 17 day extension for completion and <br />additionalcosts of $77,449.50 was unanimously approved. <br />Motion by Watson, Second by Schilling to: adopt Resolution No. 2005-10 providing for alteration ofthe completion <br />schedule for the walking path at Hillary Farm was unanimously approved. <br />Mr, Magnuson reported Vadnais Heights recently passed an Emergency Management Ordinance defining the <br />Emergency Director'sposition and compensation and asked for input; on similar action in Gem Lake. Mr. l meott <br />indicated that the Mayor is the default director for now and that should be adequate. When.appointrnents are made next <br />January,the position can be included in appointments. <br />Mr. Emeotl then indicated he has been approached by Patrick Bulen who is interested in purchasing the Scheuneman <br />Road lot From McNulty. If he purchases same and builds a home, he will have no place to live until construction is <br />complete and would like to place a mobile home on the property pending construction completion. Acting as Zoning <br />Administrator, Mr. Magnuson noted. that Ordinance No. 43 states: that the definition of permitted uses as single family <br />dwelling does not include "...trailers, tents, cabins or trailer coaches" and therefore Mr,. Bulen's request can not be <br />considered. The fullexcerpt from Ordinance No,43, Section :3.2 is as follows: <br />DWEELLING <br />A building or one (1) or more portions thereofoccupied or intended to be occupied exclusively for <br />residence purpose, but .not including roorns in motels, hotels, nursing homes, boarding houses, 1101 <br />trailers, tents, cabins or trailer coaches. <br />Magnuson then presented the Membcrship;for the. MN Association of Small Cities indicating 2005-6 Membership: <br />Dries of 5274.70 for consideration. Thematter failed on lack of a. motion. <br />Motion by Watson and second by Schilling. to accept the April Treasurer's Reports as prepared by Cobian which <br />indicate balances in the General Fund of in the Sewer Fund of$33,392.81, in the Capital Projects Fund of <br />$145.3.33,64, and in the Gem Lake Bond Debt Service Fund of $26,868..85 wereunanimously approved. Accounts <br />Payable for May/June totaling $33,588.94 was unanimously approved. <br />The next meeting ofthe Gem Lake City Council is scheduled for 18 July2005. There being nofurther business, <br />motion by Watson and second by Schilling toadjourn at 8:50 PM was unanimously approved. <br />AUTHORED: 21.
