City Attorney Trevor Oliver discussed the ordinance and if. <br />approved by the City Council, this will be in effect for two years_ This will allow the sub- <br />division to be built. The Public Hearing will be heard at the a Planning Cornmission <br />meeting on Tuesday, January 4, 2011. Councilmember Rasmussen requested to have <br />a time -line checklist. Attorney Oliver discussed the issues regarding the 60-day rule on <br />rezoning and sub -division Plat primarily approval. The council can extend the 60-day <br />rule if the time -line needs to be extended, Mayor Uzpen asked if the Planning <br />Commission should be writing the rules with Mr. McNulty, Attorney Oliver said the <br />Planning Commission is a place to start. Mr. McNulty wants to use a PUD. <br />There are some problems with Gem Lake's R3 zoning. Some of the calculations are <br />wrong and need to re -calculate. The calculation affects zone . R3 due to smaller acre <br />lots. If amending that, the council needs to have a Public Hearing at the January City <br />Council meeting. Attorney Oliver discussed the PUD rezoning using a Conditional Use <br />Permit. Councilmember Lindner discussed the open space and wetlands being <br />compromised by the PUD. Attorney Oliver recommends that Gem Lake take the time to <br />look at and use as a Conditional Use Permit or rezoning. The staff for this project <br />needs to be in place to work on rezoning and conditions of the sub -division. If rezoning <br />to one -acre Lots, the more lots that are sold will be a increased tax base for the City of <br />Gem Lake. The Planning Commission needs to have all information in order for the. <br />January Planning Commission meeting for a logical review before forwarding to the City <br />Council. This will affect the present and the future of Gem Lake, so it needs to be done <br />right. <br />Tom Riedesel from White Bear Township commented on the buildable area .of 75%. <br />The definition seems to be stricter than what he has seen in other city plans.. <br />Administrative Assistant Replacement: Councilmember Lindner asked the status on <br />the open position. Mayor Uzpen has a meeting on January 11th regarding the open <br />position. It has not been decided if the position will be part-time or full-time. <br />OPEN ITEMS <br />Mayor. Uzpen received a call from a resident that is :getting married in the summer and <br />having a DJ play at the reception outdoors at their place. They had questions regarding <br />the time limit and was wondering what the ordinance was for noise. The noise. <br />ordinance does not state the noise level or time to be done. <br />PRESENTATIONS FROM THE PUBLIC <br />Councilmember Lindner asked Justin if there were any street or culvert improvements in <br />2011.
