JuAe 2001 LMotion by lgo; Second by :Birkebak to approve this Resolution No..2001-18 granting approval of the final plat for Blue Spruce Estates (the "Plat") together with a 1.7.50 foot variance for Lot3, Block 1 ofthe Plat and a 14.30 variance for Lot 4, Block. 1 ofthe Plat, both being from the minimum 104 foot frontage on a road requirement set forth in Section 9.5 of the City'$ Ordinance \r.). 431 with the condition that no building:permits shall. be issued for any work Within the PIat beyond preliin:inary grading until e.,ch of the following conditions are met: 1. That the Plat shall be subjectto.a Declaration.ofEasements, Covenants, Conditions -and Restrictions"tn form and substance satisfactory to and approved by the City Attorney which shall. be fled for. record with the County Recorder of Ramsey County,.Minnesota (the "Declaration"). The ]declaration shallinclude language declaring that the westerly boundary fines of Lots I and 6 of the Plat delineate -the front yards for:said Lot 'for purposes of all City Ordinances. I That a Developer's Agreement. between the. Developer and the City in and substance satisfactory. to the City Attorney shall be executed and filed.of record. with. the-CountyRecorderpf.Ramsey County, Minnesota to address such conditions as are. customarily:coutained therein, including the -following; a.
