11 <br /> <br />(d) The Developer shall install survey monuments consistent with the approved <br />subdivision. Said monuments shall be installed and certified by a registered land surveyor. <br /> <br /> (e) Developer shall instruct his engineer to provide adequate field inspection <br />personnel to ensure the project is constructed in accordance with approved plans and <br />specifications. In addition, the City’s Engineer, at Developer’s expense, shall also inspect <br />the construction of Required Improvements for the purpose of certifying the same and <br />recommending acceptance by City. Developer shall also complete construction staking for <br />the project at Developer’s expense. <br /> <br />Section 4.14. Miscellaneous. <br /> <br />(a) The Developer represents that the Subdivision and Required Improvements <br />will comply with all City, County, Metropolitan, State and Federal laws and regulations, <br />including, but not limited to, subdivision ordinances, zoning ordinances, noise ordinances, <br />and environmental regulations; including wetland impact and mitigation. Developer shall <br />obtain all necessary permits and consents for the Required Improvements including, but <br />not limited to, any permits required by the Minnesota Department of Health for water main <br />extensions, any permits required by the Minnesota Pollution Control Agency for sanitary <br />sewer main extension, any permits required by the Metropolitan Council Waste Water <br />Services Division for connections to sanitary sewer lines, any permits required by the <br />Ramsey-Washington Watershed District for grading and storm water discharge; and any <br />permits or approvals necessary to properly comply with Wetland regulations. Developer <br />shall reimburse the City for any costs or expenses incurred by the City due to the need for <br />any permits or consents and shall be responsible for compliance with any other <br />requirements imposed by the agencies in question. <br /> <br />(b) Developer shall comply with the City Engineer’s recommendations, <br />including the creation of a storm water retention pond planting plan that meets with the <br />approval of Ramsey/Washington Metro Watershed District staff and City staff. Said <br />approval shall occur after the execution of this Agreement. <br /> <br />(c) Prior to the commencement of any work, Developer or his engineer shall <br />schedule a preconstruction meeting to be held at the Gem Lake City Hall at a date and time <br />agreeable to City. Said meeting shall include all parties concerned, including, but not <br />limited to, City staff, Developer’s engineer, Developer’s contractor(s), Developer’s <br />builder(s), and if necessary, representatives of Ramsey-Washington Watershed District. <br />The purpose of this meeting will be to review the work program for construction to achieve <br />a coordinated approach between all parties involved and shall include a detailed schedule <br />in writing provided by the Developer. <br /> <br />(d) Developer warrants all work required to be performed against poor material <br />and faulty workmanship for a period of two (2) years after its final completion and approval <br />by City. All landscaping including, but not limited to, trees, shrubs, grass seed, sod, native <br />plantings and aquatic plantings, if any, be warranted to be alive, of good quality and disease
