10 <br />notified at least forty-eight (48) hours prior to any and/or all construction activity. <br /> <br /> (b) The Developer shall be responsible for securing all necessary approvals and <br />permits from all appropriate Federal, State, Regional and Local jurisdictions prior to the <br />commencement of streets, trails/sidewalks, utilities, etc. <br /> <br /> (c) Inspection. All of the work shall be under and subject to the inspection and <br />approval of the City and, where appropriate, any other governmental agency having <br />jurisdiction. The City shall provide a licensed professional engineer, or their duly authorized <br />representative, to oversee, at the Developer’s expense, the Required Improvements identified <br />in this Agreement until such improvements are completed and accepted by the City. The City <br />shall conduct an inspection within forty-eight (48) hours of notice or request by the Developer. <br />The forty-eight (48) hour notice shall exclude weekends and holidays. <br /> <br /> (d) Easements. The Developer shall dedicate to the City, as part of the minor <br />subdivision approval and at no cost to the City, all permanent drainage and utility easements <br />at a minimum of 10 feet abutting all lot lines resulting from the subdivision of the property <br />and the storm sewer line as determined by the City, as set forth in the Construction Plans. It <br />shall be Developer's responsibility to obtain any and all temporary easements as may be <br />necessary for Developer's performance under this Agreement. <br /> <br /> (e) As-built drawings of all improvements identified on Attachment B shall be <br />filed with the City Engineer. Such as-built drawings shall show the date of construction and <br />shall be drawn in such a manner and on such materials to meet the standards of the City <br />available in the City engineer's office. As-built drawings must be completed and filed in the <br />City engineer's office within six (6) months of the day of the completion of such improvement. <br />If as-built drawings are not filed within the time period specified the City engineer may be <br />authorized to conduct surveys and complete the drawings and all of the costs pursuant thereto <br />shall be paid by the Developer. <br /> <br /> <br />Section 4.12. Engineering. <br /> <br />(a) The Developer shall cause to be constructed, at its cost and its own risk, the <br />Required Improvements according to City standards. All of the Required Improvements <br />shall be consistent with the approved Construction Plans. The Developer also agrees to <br />adhere to all terms and conditions as set forth by the Vadnais Lakes Area Watershed <br />Management Organization (VLAWMO). Developer shall provide a copy of the <br />VLAWMO Permit to the City prior to the commencement of construction. <br /> <br />(b) Developer or their agents or assigns, shall comply with all provisions of the <br />Storm Water Pollution Prevention Plan (SWPPP) including but not limited to keeping the <br />public streets clear of any soil, earth or debris resulting from work done by Developer or <br />his agents or assigns. Failure to comply with this provision will result in the City <br />undertaking this work with costs to be reimbursed by Developer pursuant to this <br />Agreement. <br />
