11 <br />(c) The Developer shall cause to be performed to the City Engineer’s <br />Satisfaction in accordance with the approved Construction Plans all finish grading. During <br />this period the Developer shall prevent erosion by wind and water to the pursuant to the <br />approved Storm Water Pollution Prevention Plan (SWPPP) and to the City Engineer’s <br />Satisfaction. The Developer shall prepare and as built survey which verifies elevations of <br />each structure of the constructed as each parcel is developed. <br /> <br />(d) The Developer shall install survey monuments consistent with the approved <br />subdivision. Said monuments shall be installed and certified by a registered land surveyor. <br /> <br /> (e) Developer shall instruct Developer's engineer to provide adequate field <br />inspection personnel to ensure the project is constructed in accordance with approved <br />Construction Plans. In addition, the City’s Engineer, at Developer’s expense, shall also <br />inspect the construction of Required Improvements for the purpose of certifying the same <br />and recommending acceptance by City. Developer shall also complete construction <br />staking for the project at Developer’s expense. <br /> <br />Section 4.13. Miscellaneous. <br /> <br />(a) The Developer represents that the Required Improvements will comply with <br />all City, County, Metropolitan, State and Federal laws and regulations, including, but not <br />limited to, subdivision ordinances, zoning ordinances, noise ordinances, and environmental <br />regulations. Developer shall obtain all necessary permits and consents for the Required <br />Improvements including, but not limited to any permits required by the Metropolitan <br />Council Waste Water Services Division for connections to sanitary sewer lines, any permits <br />required by the Vadnais Lakes Area Watershed Management Organization for grading and <br />storm water discharge; and any permits or approvals necessary to properly comply with <br />Wetland regulations. Developer shall reimburse the City for any costs or expenses incurred <br />by the City due to the need for any permits or consents and shall be responsible for <br />compliance with any other requirements imposed by the agencies in question. <br /> <br />(b) Prior to the commencement of any work, Developer or its engineer shall <br />schedule a preconstruction meeting to be held at the Gem Lake City Hall at a date and time <br />agreeable to City. Said meeting shall include all parties concerned, including, but not <br />limited to, City staff, Developer’s engineer, Developer’s contractor(s), Developer’s <br />builder(s), and if necessary, representatives of Vadnais Lakes Area Watershed <br />Management Organization. The purpose of this meeting will be to review the work <br />program for construction to achieve a coordinated approach between all parties involved <br />and shall include a detailed schedule in writing provided by the Developer. <br /> <br />(c) Developer warrants all work with respect to the Public Infrastructure <br />Improvements to be performed against poor material and faulty workmanship for a period <br />of two (2) years after its final completion and approval by City. The warranties set forth <br />herein shall be secured by the performance bond provided pursuant to Section 6.2 of this <br />Agreement. <br /> <br />Commented [AR3]: This is Justin’s language
