<br /> <br /> <br />consistency, or grammar. The following highlights the substantive changes made to the draft <br />JPA based on the member community staff comments received in May: <br /> <br />1. The language about the “final budget” needing to be adopted by December 31 was <br />revised to reflect to indicate that any budget adjustments required to allocate carry- <br />overfunds need to be made by December 31 (Sec. 6.1(f) ) <br /> <br />2. If there was ever a member assessment, the date by which that decision needs to be <br />made was changed from September 1 to July 1 to better accommodate the city <br />budgeting process (Sec. 6.3). <br /> <br />3. The duration of the JPA was revised back to previous language, which was 10 years; <br />(Sec. 7.1). The JPA can be amended at any time in the future if needed (Sec. 8.4). <br /> <br />4. The method for selecting a mediator if the parties cannot agree on a mediator under <br />the dispute resolution process in Sec. 8.2 was revised to have the Chair make the <br />selection or, if the Chair’s community is involved, then to have the Vice-Chair make <br />the selection. <br /> <br />5. Revisions to Sec 7.4 regarding the allocation of assets if VLAWMO was dissolved to <br />remove references to real property. <br /> <br />6. The voting requirement to approve the annual budget was revised. (see note below <br />regarding subsequent comments from BWSR). <br />The VLAWMO Board considered the revised JPA at its June 25, 2025 meeting and adopted a <br />VLAWMO Resolution 05-2025 (See attachment 4) to approve forwarding the JPA to BWSR <br />for review and then to the member communities. <br />The draft JPA was then sent to BWSR for review and comment as is required by State law. <br />Upon review, BWSR provided four comments which were mostly minor and focused on <br />detailed policy matters related to Board meeting logistics /noticing and adding a reference <br />related to the VLAWMO annual report work plan. The BWSR also commented that the voting <br />requirement section included in VLAWMO’s annual budget process (referred to in Sections 3 <br />and 6 of the JPA) require a majority vote. Staff made these revisions to respond to BWSR’s <br />comments and the revised the JPA. On Tues. July 29, 2025, VLAWMO staff sent out the final <br />update JPA to member community staff. The City of Lino Lakes staff then sent an email on <br />Wed. July 30, 2025 regarding a question on the proposed language in section 3.14 of the <br />JPA regarding voting requirements for capital improvements. Based on this question and <br />subsequent discussions, VLAWMO revised the language in Section 3.14 as follows:
