Consolidated Land Use Ordinance No. 131 Update <br />Gem Lake Planning Commission 7/8/25 <br />June 24, 2025 <br />Page 10 <br /> <br /> <br /> <br />Table 5: General Provisions Current and Proposed <br />Section Current Uses Proposed Uses <br />16.8 - <br />Farming <br />Operations <br />• All farms in existence upon the effective <br />date of this Ordinance and all farms which <br />are brought into the City by annexation <br />shall be a permitted use where the <br />operator can conduct a farming operation. <br />However, all regulations contained herein <br />and other City Ordinances as in effect <br />shall apply to all changes of the farming <br />operation which will cause all or part of <br />the area to become more intensively used <br />or more urban in character. See <br />Residential Zoning Districts for additional <br />regulations of agricultural buildings. <br />• All farms in existence upon the <br />effective date of this Ordinance and <br />all farms which are brought into the <br />City by annexation shall be a <br />permitted use where the operator can <br />conduct a farming operation. <br />However, all regulations contained <br />herein and other City Ordinances as <br />in effect shall apply to all changes of <br />the farming operation which will <br />cause all or part of the area to <br />become more intensively used or <br />more urban in character. See <br />Residential Zoning Districts for <br />additional regulations of agricultural <br />buildings. <br />• Structures in which farm animals or <br />fowl are to be housed shall require a <br />setback of one hundred (100’) feet of <br />any lot line except where the <br />following conditions may provide for <br />easing the restriction: <br />i. The structure shall be partially <br />screened from the views from <br />neighboring horses, with said <br />screening to be existing or <br />planted and maintained <br />vegetation or the natural <br />topography of the lot and <br />surrounding land and with the <br />amount of screening to be <br />measured at full growth in the <br />summer season; <br />ii. The structure shall be at least <br />one-hundred (100’0”) feet from <br />any well, ISTS or neighboring <br />dwelling; <br />iii. The drainage characteristics of <br />the land shall be such that the <br />concentration of animal and <br />animal waste shall not cause real <br />or potential pollution or nuisance <br />problems; <br />iv. The design and construction <br />materials of the structure shall be <br />consistent with the main swelling <br />on the property; <br />v. Such other factors as may be <br />deemed material by the City. <br />
