Consolidated Land Use Ordinance No. 131 Update <br />Gem Lake Planning Commission 7/8/25 <br />June 24, 2025 <br />Page 11 <br /> <br /> <br /> <br />FUTURE AMENDMENTS <br />Staff has identified the following sections that may be reviewed in the future. <br />• Consider reworking specific uses and standards for OS/R in relation to PUD before or during the upcoming <br />Comprehensive Plan update. <br />• Add sub-zone uses subsection referencing Figures 16 & 17 in section 9.1. <br />• Move information related to farm animal structures to section 16.8. <br />• Add fence regulation to section 16.13. <br />• Update Section 8, Gateway District concurrently with the Comprehensive Plan. <br />o Provide clarity on the Building Type Templates <br />o Consider updating density requirements <br />o Reformat the building type templates to be digitally accessible and easily editable <br /> <br />APPENDIX A UPDATE <br /> <br />The following definitions were added or changed in Appendix A. <br />• Conservatory – A room, typically with glad roof and walls, attached to a house at one side and used as a <br />greenhouse. <br />• Domestic Worker – A person who works within a private residence, providing services of a household <br />nature, such as a home care worker, house cleaners, and nannies. <br />• Greenhouse – A climate-controlled structure enclosed by glass or multiple layers of plastic in which plants <br />are grown that need protection from cold weather. <br />• Market Garden – An area of land used for small-scale production of fruits, vegetables, and flowers to be <br />sold, usually directly to consumers through on-farm stands, local markets, and local businesses. <br />• Office, Supplemental Retail – A building in which at least twenty (20%) percent of the floor space is <br />devoted to selling products or services that are secondary to the primary product or service, not including <br />automotive repair services. <br />• Office, Related Repair – A building in which at least twenty (20%) percent of the floor space is devoted to <br />providing repair services, related to the primary use of the building, not including automotive repair services. <br />• Roomer – A renter of a room in another person’s home <br />• Shed – A structure on a property that is not a primary building nor a structure intended to house parked cars <br />or trucks. Generally a smaller building intended for the storage of home maintenance equipment and other <br />personal belongings. One-story detached structures that do not exceed 200 square feet, do not require <br />building permits, in accordance with the Minnesota State Building Code (MSBC). <br />• Use, Conditional – A land use or development which because of its unique characteristics, cannot be <br />appropriately classified as a permitted use in a specific zoning district. Its approval is subject to special <br />conditions to ensure compatibility with the public welfare, health, safety, and the City’s Comprehensive Plan, <br />considering the public need for the use at the proposed location. <br />• Use, Interim – A temporary use of land or structures, permitted for a limited period, that is not the ultimate <br />intended use for the zoning district. The use is personal to the user or occupant and does not run with the <br />land. Interim uses are allowed under specific conditions and are intended to be discontinued upon a <br />predetermined event or timeframe. <br /> <br />ACTION <br /> <br />The Commission should review the drafted ordinance and consider any additional amendments. If the <br />Commission desires additional amendments, direction regarding changes should be provided to staff. <br />The Commission may also recommend the City Council approve the proposed amendments as proposed by staff, <br />if no additional changes are desired.
