Updated January 2025 – Gem Lake Consolidated Land Use Ordinance No. 131 97 <br /> <br />1. Residential Districts. <br /> <br />1. In Residential Districts, all materials and equipment shall be stored within a building or fully screened (so <br />as not to be visible) from adjoining properties or a street, except for the following; laundry drying and <br />recreational equipment, construction and landscaping materials and equipment currently being used on the <br />premises, agricultural equipment and materials if these are used or intended for use on the premises, off - <br />street parking of passenger automobiles and pick -up trucks, except inoperative automobiles and trucks <br />may be parked once for a period of time not to exceed fourteen (14) days. <br /> <br />2. The use of commercial storage equipment and/or semi-trailer type containers or other similar portable <br />storage units is not allowed in any residential district except when used in conjunction with an Interim Use <br />Permit, issuance of which is not subject to a public hearing, issued for a period of not more than one- <br />hundred twenty (120) days in conjunction with a properly issued Building Permit for the property. <br />Whenever possible, such containers should be restricted to a location in the side or rear yard. <br /> <br />2. Business District. <br /> <br />1. In business districts all materials, equipment and vehicles shall be stored in a building or fully screened <br />(so as not to be visible) from adjoining properties or a street except for: <br /> <br />1. Temporary storage of construction and landscaping materials currently being used on the <br />premises. <br /> <br />2. Open Storage Lots where screening but not a building shall be required. <br /> <br />3. Open Sales or Rental Lots where merchandise for retail sales or rental may be displayed in areas <br />designated by the required Site Plan or a Conditional or Interim Use Permit. <br /> <br />2. The use of commercial storage equipment and/or semi-trailer type containers or other similar portable <br />storage units is not allowed in any business district unless an Interim Use Permit for a period not to exceed <br />one-hundred eighty (180) days is first secured in accordance with Section 17.5 of this Ordinance. <br />Whenever possible, such containers should be restricted to a location in the side or rear yard. <br /> <br />4. Refuse. <br /> <br />1. In all Districts, all waste material, debris, refuse, or garbage shall be kept in an enclosed building or properly <br />contained in a closed container designed for such purposes. Farms may be excluded from this requirement <br />providing the waste material is that commonly associated and incidental to normal farm operations. The owner of <br />vacant land shall be responsible for keeping such land free of refuse, and weeds. <br /> <br />1. In all non-residential districts, all commercial refuse containers shall be enclosed in a building or properly <br />fenced or screened to prevent any refuse from spilling beyond the fenced or screened area and to prevent <br />access by children or other unauthorized persons. Fences or screens shall also be subject to the provisions <br />for same found elsewhere in this ordinance. <br /> <br />2. In all Districts, no person shall store, park or permit the parking or storage of any junked vehicle, machinery or <br />equipment external to any structure, on any property within the city. <br /> <br />5. Screening. <br /> <br />1. Screening shall be required in all zones where: <br /> <br />1. Any off-street parking area contains more than four parking spaces and is within thirty (30') feet of an <br />adjoining residential use or zone; and <br /> <br />2. Where the driveway <br /> <br />3. To a parking area of more than six (6) parking spaces is within fifteen (15') feet of an adjoining residential <br />use or zone. <br /> <br />2. Where any business or industrial use (structure, parking or storage) is adjacent to property zoned or developed for <br />residential use, that business or industry shall provide screening along the boundary of the residential property.
