Updated January 2025 – Gem Lake Consolidated Land Use Ordinance No. 131 98 <br /> <br />Screening shall also be provided where a business or industry is across the street from a developed residential zone, <br />but not on that side of a business or industry considered to be the front (as determined by the Building Inspector). <br /> <br />3. In all districts, all exterior storage shall be screened. The exceptions are: <br /> <br />1. Retail merchandise being displayed in front of the structure; <br /> <br />2. Materials and equipment being used for construction on the premises; <br /> <br />3. Merchandise located on service station pump islands. <br /> <br />4. The screening in this section shall consist of a solid fence or wall not less than five (5') feet high, but shall not <br />extend within fifteen (15') feet of any street, right -of-way or driveway. The screening shall be placed along <br />property lines or in case of screening along a street, fifteen (15') feet from the street right -of-way with landscaping <br />between the screening and the pavement. A louvered fence shall be considered “solid” if it blocks direct vision. <br />Planting of a type approved by the Council may also be used as a screening. <br /> <br />1. Screening shall also be subject to additional provisions of other sections of this Ordinance. <br /> <br />6. Landscaping. <br /> <br />1. In all Districts, all exposed ground areas surrounding or within a principal or accessory use including but not <br />limited to street boulevards not devoted to drives, sidewalks, patios and the like shall be landscaped. <br /> <br />2. Landscaped yards shall be provided along all streets, both public and private. Landscaped yards shall not be used <br />for parking of vehicles or equipment or for storage or display of household items, materials, supplies or <br />merchandise advertised for sale. Landscaped yards shall be at least twenty (20') feet in depth along all streets <br />measured from the right-of-way. Except for driveways, the yard shall extend along the entire frontage of the lot <br />and, in the case of a corner lot, along both streets. <br /> <br />3. All property owners and their (sub-) contractors shall employ and maintain sediment and erosion control in <br />accordance with Section 22 of this ordinance until landscaping is complete. <br /> <br />4. All landscaping shall be completed within one (1) growing season after completion of any development, grading <br />and filling, construction, or other activity which shall result in exposed ground on the property. <br /> <br />7. Maintenance. <br /> <br />1. In all Districts, all structures, landscaping and fences shall be maintained so as not be unsightly or present harmful <br />health and safety or nuisance conditions to the adjoining areas. <br /> <br />8. Lighting and Glare. <br /> <br />1. In all Districts, any lighting shall be arranged as to deflect light from all adjoining property, and from the public <br />streets and highways. Direct or sky-reflected glare, whether from lighting or from high temperature processes such <br />as welding, shall not be directed into any adjoining p roperty. <br /> <br />2. Glare or Heat. Any use requiring an operation producing an intense heat or light transmission shall be performed <br />with the necessary shielding to prevent such heat or light from being detectable at the lot line of the site on which <br />the use is located. <br /> <br />3. Outdoor Lighting. All outdoor lighting shall be so designed and installed so that light will not be directed onto <br />adjoining property or public streets and highways. Lighting units shall be properly shielded to give no upward <br />component of light to create a sky-glow. <br /> <br />1. Outdoor lighting fixtures shall be mounted at the lowest possible level above ground, but in no case shall <br />any pole or structure for mounting such fixtures exceed the maximum principal structure height <br />restrictions. <br />
