The City Code does not set explicit dates or timeframes for this, but <br />states that a home occupation use shall be incidental and secondary to the property’s primary <br />residential use. <br /> <br />After our phone conversation, I would strongly recommend that you and Nikki consider the potential risk <br />and confirm whether you intend the primary use to be residential or commercial because the primary use <br />needs to continue to be residential with the home occupation being subordinate or accessory. If neither <br />you or Nikki intend to live regularly in the house, then it would be di Ưicult to support this from a CUP or a <br />Home Occupation perspective because it would operate primarily as a commercial property. <br /> <br />I ran this proposal by the City Attorney as well to confirm my interpretation and concerns, and he had the <br />same position, the home occupation has to be “incidental and secondary to a property’s primary <br />residential use. A home occupation use shall not change the residential character of the property <br />or the neighborhood.” <br /> <br />If your intention is to maintain the property’s primary residential use with either yourself or Nikki residing <br />there and the home occupation is incidental and secondary to the principal use, then I would continue <br />with your application. If that is not your intention in establishing a new use, then I would withdraw the <br />application. <br /> <br />I’m happy to discuss this further if you’d like, but understand that you are on a timeline as well, so let me <br />know how you would like to proceed.
