Revised 8/24/11 <br />§501.030 PUBLIC HEALTH, WELFARE AND SANITATION §501.041 <br /> <br /> <br /> Subd. 6. Yard Waste. Yard waste shall mean lawn cuttings, leaves, weeds, garden <br />wastes and soft-bodied plants. (Ref. Ord. 1000, 3/11/03) <br /> <br /> Subd. 7. Yard Waste Container. The term yard waste container as used herein shall <br />mean a plastic waterproof bag of up to thirty-nine (39) gallon size and one and one-half (1 ½ ) mil <br />thickness and shall not exceed thirty-five (35) pounds in weight when full. (Ref. Ord. 1000, 3/11/03) <br /> <br />§501.030 GARBAGE COLLECTION; UNLAWFUL ACTS. It shall be unlawful for any person, firm or <br />corporation to not dispose of refuse and yard waste which accumulates upon their property at least <br />once a week. Every householder, occupant or owner of any single family dwelling unit or any other <br />structure utilized for dwelling purposes shall use the garbage and refuse collection service as <br />provided by the City of White Bear Lake. Multi-family housing units are exempt from this contract <br />requirement. (Ref. Ord. Nos. 495, 6/9/70; 554, 7/10/73; Ord. 873, 6-14-92; Ord. 1000, 3/11/03) <br /> <br />§501.040 REFUSE YARD WASTE AND RECYCLABLES COLLECTION: CONTAINERS REQUIRED, EXCEPTION, <br />COLLECTION. All refuse (excluding Christmas trees) shall be kept in containers as defined above. All <br />yard waste shall be kept in yard waste containers or refuse containers as defined above. All <br />recyclable material shall be kept in a container made available through the City’s recycling program <br />or other container approved by the Director of Public Works. There is no limit to the number of <br />refuse containers that will be picked up. (Ref. Ord. 873, 6/14/92) <br /> <br />Pick-up and disposal of refuse from multi-family housing dwelling units shall be by a <br />standard rubbish container of one (1), two (2), three (3) or four (4) cubic yard capacity, to be <br />furnished by and maintained by the Contractor. Actual service needs are to be determined by volume <br />accumulations as determined by the Code Enforcement Officer, upon review with the Contractor. <br />Container service is subject to continuing review by the Code Enforcement Officer. <br /> <br />Other types of containers such as oil drums, fiber drums, barrels, cardboard boxes and <br />paper bags will not be accepted as refuse or garbage containers. <br /> <br />On the collection day determined by the City, refuse, yard waste, and recycling <br />containers shall be placed on the curb along the public roadway adjacent to the customer's building <br />and in areas where there is a public alley, containers shall be placed on the alley line for collection; <br />provided, that special "walk-in" service at the dwelling shall be provided for handicapped persons <br />who have filed a doctor's certificate with the City Clerk. Containers must be placed properly for <br />pick-up prior to six (6:00) o'clock a.m. on the day of collection to ensure service. The Contractor <br />shall complete pickups by ten (10:00) o'clock p.m. unless emergency permission is granted by the <br />City Manager's office. <br /> <br />§501.041 ENCLOSURE OF CONTAINERS. All garbage or refuse containers exceeding seventy-five (75) <br />gallons in size and located on property used for purposes other than single family residential, shall be <br />contained within a building or within an area which has an impermeable floor surface and is enclosed <br />and screened within a 90% or greater opaque wooden or metal fence or masonry wall not less than <br />six (6) feet in height having a gate or doorway which remains closed except for access purposes. All <br />enclosures must be large enough to allow adequate area for the storage of recyclable material <br />containers. (Ref. Ord. 873, 6/14/92) <br /> <br />In cases of special hardship, the applicant may apply for a variance as provided for in §1301.060, and <br />the City Council may grant a variance from the requirements of this section and establishing special <br />requirements necessitated by the variance.
