Ord. No. 131, Section 9.6.5 was amended in <br />2018 to allow as a conditional use automotive dealerships and convenience stores “when a use in an abutting <br />community is proposed to expand into Gem Lake, that use shall be considered a conditional use. Abutting <br />property shall not be separated by a railroad or public right-of-way.” This amendment allowed for the parking lot of <br />the Luther Cadillac dealership located within Vadnais Heights to extend into the southern end of the city. This <br />‘exception’ in Ord. No. 131 would not apply to the Kia site. <br />The closest building type template that could accommodate an automotive dealership is Figure 15 in Ord. No. <br />131, Section 8 (see Figure 5 below). Section 9.6.4 states “New building types may be proposed in the manner of <br />other amendments to the Zoning Code using the procedure in Section 17.6 of this Ordinance. A proposal must <br />contain all information included in existing analogous Building Types, including but not limited to the dimensional <br />standards, use designations, and frontage requirements.” <br /> Figure 5: Excerpt from Ord.
