Variance – 1201 County Rd E <br />Gem Lake Planning Commission 9/10/24 <br />August 27, 2024 <br />Page 5 <br /> <br /> <br />7. Consistency with the Comprehensive Plan. <br />The Comprehensive Plan is silent on accessory structures. The zoning ordinance (Ord. No. 131) is meant <br />to carry out the implementation of the Plan. Apart from the setback requirement, the property meets other <br />zoning requirements. <br /> <br />To summarize the requirements of 17.4.1 and 17.4.2.2 above, staff finds that most of the criteria are met. The <br />commissioners should discuss whether the ‘plight of the landowner is due to circumstances unique to the <br />property’ and whether said plight was or was not created by the landowner. <br /> <br />Staff Comments <br /> <br />The project plans were forwarded to staff and other agencies for comments prior to the Planning Commission <br />meeting. <br /> <br />▪ Ramsey County <br />o County staff is currently reviewing the plans and had not submitted comments at the time of <br />drafting this report. <br />▪ Vadnais Heights Watershed Management Organization (VLAWMO) <br />o The watershed staff had no comments on this request. <br />▪ Building Inspector <br />o The Building Inspector confirmed that the site of the proposed shed was included in their plans <br />that were approved for building permits in April of 2024. The as-built shed does not meet setback <br />requirements, but it was noted that other requirements are met. <br />▪ Engineering <br />o Engineering staff are currently reviewing the submitted plans and had not submitted comments at <br />the time of drafting this report. <br /> <br />ACTION <br /> <br />The Planning Commission has the following options: <br /> <br />1. Recommend approval of the request by the City Council, with or without conditions. <br />2. Recommend denial of the request by the City Council, with findings for denial. <br />3. Table the request for further review/study. <br /> <br />RECOMMENDATION <br /> <br />Staff recommends the commissioners review and discuss the criteria for a variance. If the commissioners find the <br />request does not meet the criteria for a variance, the commission can direct staff to prepare a resolution of denial <br />for the City Council to consider. <br /> <br />If the commissioners recommend approval of the request, the commission can direct staff to prepare a resolution <br />of denial for the City Council to consider. In addition, the following conditions are recommended: <br />1. The as-built shed shall adhere to the 33.2-foot setback from the south property line, as shown in the plans <br />reviewed with this request and the plans approved as part of the original building permit issued in April <br />2024. <br />2. The as-built shed shall adhere to other applicable local, State, and Federal requirements. <br />3. The applicant shall pay all fees and escrows associated with this request. <br /> <br /> <br />EPM:jdc
